Hi,
My current EAD is valid until Oct 3,2008 and AP valid until Nov 2008. I am going for vacation to India and planning on going for visa stamping. My H1B I797 notice is valid until Aug 2009. Once when I enter with H1 visa, I am in H1 status.

(1) Should I need to apply for my EAD renewal before Jul 3,2008 - 90 days before the expiration of current EAD. I am not going to switch my employer.

(2) Can I use H1 Visa and work until Aug 2009 for the same employer and apply for EAD renewal somewhere in Jun 2009? How will that work?

Please let me know so that I have to get my tickets.

EAD and AP applications are optional. You can elect to apply for them or no. If you are using your H to work and travel you do not need to apply/renew your AP and EAD. If one or both expired and later on at any time you want to get new one no problem at all

-----------------It seems you have H1 petition Approval and I-94 valid till Aug 2009 and no Visa stamp, if you dont have Visa stamp till Aug 2009 then you need to get H1 Visa stamped so that you can enter on H1 status.if any problems or delay in Visa stamp then apply AP as Back up

----------------you have to decide that, many keep valid EAD for emergency use and one can apply EAD renewal 120 days before the date of EAD expiry date

-------------------If you get the Visa stamp you can enter on H1 status and can work on H1 status and can remain on H1 status. if see any problems for Visa stamping then apply EAD/AP as back up options
