Need help about I-130, Petition for Alien Relative process

I have a question,hope i will get some help here :

Q 1:

We have recieved a letter from NVC for me,my parents and my brother to pay a amount of $404 as processing fee.My father is the principal benificiary and we are derivative beneficiaries.Now my question is ,is it possible for me to go US without my father by sending the amount to NVC just for me and doing further process ??

No. If the principal does not go then nobody can accompany or follow-to-join. A derivative can NEVER precede the principal as an immigrant.


Before anyone jumps down my throat, it is possible for a derivative to enter the U.S. in some non-immigrant category, such as on a student visa and wait for a principal to enter and then file for adjustment....but that is not what has been suggested here.

I want to know, what are all the questions we will be asked in the US embassy after NVC sent our case to embassy.Because in my father's(principal beneficiary) passport,his place of birth is wrong.It differs from what his brother(the sponsor) has been written in the I-130 form.My father's brother(sponsor in chicago) told us to correct the place of birth.Is it necessary to change the place of birth? Do the embassy consider it ? (We are from India).

The U.S. Consulate is well aware of the lousy old written records (or lack thereof) in India.

Go here: http://travel.state.gov/visa/fees/fees_3272.html and select the country of interest and see what the Consulate expects.

My Grand mother's green card expired last year without renewal.Now she wants to go back USA.is it possible ?

Does she have re-entry permit? How long has she been outside the U.S.? You have not given enough information.

She has long since abandoned her LPR status by staying abraod over a year without a re-entry permit. An SB-1 visa is HIGHLY unlikely to be an option. If she wishes to return to the U.S. as an LPR she will need to re-immigrate IF someone can petition for her.

IF she just wants to visit, she should contact the Embassy/Consulate, complete an I-407 to relinquish her green card and apply for a B visa.
