I' m going through divorce which is in the final stages.I have the H1 copy of my spouse and this is the H1 my spouse held with a compnay from which he was layed off and he later transferrd his H1 to another company.This happened in 12/02.When I checekd online in the officical website of INS it doesn't show anyhting about the old H1 being revoked.It just shows the dates when it was approved.My spouse is not giving me his new documents though he was to give me as per the divorce proceedings.I'm handling that right now.Meanwhile can I go ahead and apply for H1 using this old H1.I also have a copy of his passport .I can't produce his pay stub and employer letter.so with what I hava i.e passport copy of my spouse and old H1 can I apply for change of my visa status from H4-H1.Will writing to INS about my happening divorce (as the reason why I'm not able to get the pay stubs and employer letter)help me in any way in changing my status to H1 or will it harm me.

You need some serious lawyer advice. Try with AILA.ORG

Once you are divorced, you lose H4 status, having that in the clause of divorce arrangments will not prevent immigration move against you or deny your H4 to H1.

You should have put timelines on the production of document, you should have also insisted on your spouse applying for H4 visa extension so that you will have some more time preparation for plunging into the H1 Market.

There are no employer lists. Search the internet. Better hook up with a local users group or local ethnic club and try to network and start a soft job. Degree is not enough.
