hi
we are in a dilemma.
presently i am on h4 with my husband and we have to go for multiple visa stamping. The problem is this. A petition has also been filed for my father by his real brother (my uncle). And my name is also there as his child.
So now if I go for multiple visa stamping with my husband, would there be any complications? I would want to come back to USA with my husband on H4.

My name is identical both on my dad's petion papers as well as my husband's papers. What to do?

thanks.

What is your age at the time of filing I 130 by your uncle for your father.

Again, for H4 it does not matter. If it is for F, then you will not get visa, period as pending immigrant.

thanks for the message

my uncle has filed it very recently..at my age of 32.
its only a two months or so and now we are thinking of getting my multiple entry visa stamping done too for my H4 but are worried about consequences.
kindly advice.
thanks.

You are not eligible to be included in the petition (FB4) filed by your uncle (age out). So you are not a pending immigrant at all.

kindly also tell,
1. what is the minimum age to remain active in the petition. Like i am 32 and i am age out, but what is the minimum accepted age?
2. I assume it is ok for me to go for my multiple H4 visa stamping to canada or mexico?
3. If my husband goes first to Canada or Mexico and gets his visa stamped, is it ok if I go to India later on and get H4 stamped there only after say 5-6 months? Would it be a problem?

I really appreciate the advice..
and valuable insight. Thank you.
