Experts please advice.

My wife filed for my green card in June, 2005. I received my I-485 interview call notice in September, did interview last week (28thNov). Thinking i would receive my Permanent Resident Card in weeks after interview, I dint apply for I-131. I was/am planning to travel in first week of January'06. The INS officer said every thing is okay on my application but FBI clearance is still pending, so he cant approve it until FBI clearance is approved (which he told could take either 1 day or upto 9 months). If I apply for I-131 now through mail it will take atleast couple of months to approve. I do know an Emergency advanced parole can be filed in person, and it could be only in case of medical emergency. If i get a dr. letter from india saying my aunt or grand parent is sick would that be okay. Or i need a letter from immediate family? Reason, I am asking about immediate family is because my parents were in US untill this tuesday (6th dec) and went to india. If i show my dad or mom is sick and i need to go and just in case they verify the information I would be screw'd. I need to go no matter what but need approved AP. Does INS local office they make a big deal in approving emergency AP? I am in located in los angeles, CA.
Any comments / tips would be highly appreciated. If any body can post their experience would be appreciated.

P.S: I apologize if my post is redundant, i searched on the portal but couldnt find any similar post.

You can try visiting local uscis office with a medical letter of India based doctor.

Nvontime:

I think India doctor is ok, but you'd better have someone to notarize or certify it and also the English translation. My experience with the district office is that they are reasonable people. Not sure about LA office though since I am not in CA. Try to be polite and explain to them your problem, and remember bringing as much as evidence as you can. Good luck.

EAin2005 / fast_gc_seeker ...

Thank you for the quick response. Your reply is really appreciated. I am gonna ask a letter from our family doctor that one of my immediate family is sick and needs urgent care. Do you think that will work? I will ask to type it in english so its okay. Do you guys think that should be okay or I should add more stuff? I just want the AP approved, just desperate. I havent applied for I-131 form. I am just gonna go to the local office directly with my forms, hope thas okay.
Once again thank you for the reply.

nvontime, please post your experience on this forum on visiting the INS office so others can also benefit from it. Thanks.

falcon7a,

I havent gonne to the INS office yet. One of our family friend surgeon denied to write a letter specifying emergency for my immediate family saying INS does cross verification which is kinda stupid (I am pretty sure there is no verification for AP) ... So my family is gonna ask our family doc to write up something ... not sure what exactly to write ... if any body can give any input that would appreciated.
Thanks,

Went over the to INS office today, they were not helpful. I didn't have a real emergency though, just some reports from a doctor showing a family member as being sick. It has been 60 days since the ND for my AP, the lady at INS said that it will take 90 days from ND for AP to arrive. However, looking around this forum, it seems most people get their AP within 60 days.

Does anyone know what one can do after 90 days pass since the ND application? Thanks.

falcon7a,

Can you tell me what document you took along with you.
1) Was the document from a family doctor
2) Where the documents certified (notarized over here) or the documents were original?
3) What reason did u show for emergency - ie heart attack/surgery
4) Was it an immediate family member you should for emergency?

I am getting scared now, if that happens to me i m mess'd up. I would really appreciate your reply.

Also one more, can you tell your location?
Thanks again.

Please Respond me ASAP by today -Thanks

nvontime & falcon7a,

I am also in the same boat, I got approved my I-131 on November 29th, 2005. Now I passed 14 days time too, still I haven't received my travel documents yet, I already have ticket booked for 29th Dec, 05.
Now I am planned to visit the USCIS office tomorrow in person to get my emergency I-131 documents.

nvontime & falcon7a, could you advice me what are the chances of getting my Travel Documents, and also let me know do I have to carry any emergency letter for this ?

your response will be greatly appreciated.

Thanks
smBasha

Yes

The documents were not certified. The officer didn't even look at the documents. She said that she would only consider documents proving a life threatning situation.
3) What reason did u show for emergency - ie heart attack/surgery
Mother unwell, but not life threatening
4) Was it an immediate family member you should for emergency?
Yes

Chicago
Thanks again.

smbasha,

Chances of emergency AP are not good. USCIS seems to have already approved your AP, I think you need to file an application for a lost AP. Ask the officer for exact instructions. From my experience, they don't grant emergency AP unless its a life or death matter.

I got a letter fax'd from home country about my dad's by-pass surgery.
I might be going to local office to get an emegery AP. How do I notarize this thing, the letter is already in English and it is from my dad's cardiologist. I mean what else can one can get? Everybody say, get as much evidence ... I mean what else can I get ? Should I ask my dad to fax me his presciptions? He has severe diabetes, would that help ...
I wished INS was less tuff on approving AP, I mean we r not committing crime and running out of country or something...

Thanks,
If your friend doctor denied to write such letter, that means you lie :D
Why you are sure there is no verification for AP? Any law said so or just you.

falcon7a,

Did they took your application / fees / photos etc? I went to local office today. They took my application and told me some one will contact me within 3-4 days. They took the money order too. Does this mean anything positive?
This ARE the TOUGHEST days of my life. I cant stop thinking about this thing. I just wished I had applied for I131 6 months back. I am hoping for the best.

I got approved for Emergency AP from local office today. I called my local congressman office and requested them to check the status of my application at the local USCIS office. Today morning, I went to the local office and my application was approved. I had terrible nightmares for last week (thinking WHAT IF not approved)... Anyways, I feel relaxed now ... Thank you falcon7a and others for replies to my questions. If anybody needs any help or have questions please let me know.

when you went to local office?

Did you submit a new I-131 form at local office? Was your
I-131 pending at the Service Center why you went to local office?

Please give an outline of what all things to take'
