im in a unique situation im a born US citizen and i met my fiancee on a work and travel program from Thailand. She has the opportunity to back on another work and travel program on a j1 visa. My question is would it be easier for us to get married or get a marriage licensee while she is in the us as apposed to waiting on a k1 visa. If we do get married while she is on the work and travel program would it be easier to get her stay in the US, or to come back to US from Thailand after the program has ended?

Assuming she is currently on J-1 status, does the 2 year HRR apply to her? Check her visa sticker.

her visa says "no subject to 2 HRR" her program would only last for 3 months if she signs up for it. she still has not confirmed to go yet. im trying to see if she should sign up for an we get married while she is in us. or do i tell her to wait for a kvisa to come to USA. i mean should i take advantage of this opportunity to have her in the us to get married or will it backfire on us.

If she is already in the US, and has been in the US for more than 90 days, I would advise you both to marry and apply for her AOS.

ok, thanks for reply i also wanted to know once her program ends her j visa says The 30-day grace or travel status period is intended to be a period following the end of the exchange visitor’s program and is to be used for domestic travel and/or to prepare for and depart from the U.S., and for no other purpose. my question is during this grace period is she eligible to get married, and apply for AOS.

ps thanks for the replys trying to get as much info as i can.

She can apply safely for AOS at any time, as long as 90 days have passed since her last entry to the US and the marriage was a spur of the moment decision.

my question is during this grace period is she eligible to get married, and apply for AOS.

How long does it take for the adjustment of status to complete. if we get married and her j1 visa only has like 30 days left. will she have enough time left for her status to change.

AOS can take anywhere between 3 months and 8 months on average (some people's takes longer, some shorter...its all case dependent.
Once you receive the receipt (NOA1) when you send in the AOS petition, this will make your wifes status as 'AOS pending'...so her status will then be protected regardless of her grace period ending. NOA1 is usually received within a month of filing.

Once she files for I-485, it really does not matter if her I-94 expires before her AOS interview.
