name misspelt on H-1..will it affect I140 filing..?

Hi guys,

My name was misspelt on my H-1 approval notice.Even though i didn't have any middle initial,they put a middle initial.My labor was cleared few days back and am planning to apply for I-140 and I-485 concurrently..?Will this affect them in anyway..?Can I go ahead and apply for them?My lawyer says that he will put in a amendment notice to BCIS today.

Thanks for replying.But in the meantime can I go ahead with the filing of I140 and I1485? Will there be any issues?
 
You should apply, but ask your lawyer if the info on the H1b was mistake of BCIS? If BCIS did that then they can correct it, and will mail you new notice in short time, why did not you noted earlier? They have instruction on the H1 approval notice that if any info is wrong you should inform them, why you did not inform them? Lawyer should make a note and can also send request for the correction, if the mistake was from your side, employer side or lawyer side they may take time to correct it. But your DOB, Name, Place of Birth, SSN is same, I don’t think any problem if lawyer submits a note and if they need any info in future or send RFE that can be replied later, AOS is going to take a long time. Please follow your lawyer
