Name check completion not required for I-485 Adjudication

I agree with Jackolantern....In the new revised structure - renewals are free.....that's how USCIS justified their fee hikes....saying....it's really not that expensive....

But, I agree, this information is still shrouded in the bills...etc....and not clearly spelled out on the I-765 /I-131 forms.....thus feeding to the WIDESPREAD CONFUSION!

Wonder, when USCIS will clear this cloud of no new renewal fees under the new fee structure!

It should be "First come first serve" from the very beginning.
With the VISA quota limitation, I wonder how they prioritize the cases. Do they sort the cases by PD or RD to approve the old cases or they simply approve cases randomly?
I hope they don't do it randomly as it will still not fair for those who have filed long time ago and waited for so long.
 
I agree. I am still not 100% sure that it will be implemented, because of years of mess-ups.

Folks .. USCIS is already approving cases which has PD current but stuck in NC for years. I spoke to the lady at NSC and she told me I should hear back from NSC in a month since my PD is Apr'2006 and stuck in NC since Jun'2006
 
It is not possible to speak with l Texas serv. Center

I tried several times to call Texas Service center - all the time get message - No immigration officer can take your call. Any thoughts?
 
does anyone know if this applies to people stuck in background check as well or only people stuck in name check?

I dont know. I was told by the rep from my congressman's office that the FBI informed them that my "background check" is still ongoing. The rep said this was different from the "name check" she was told by FBI about for other candidates she is also following up on. Does she just not know what she is talking about?

A year ago, when I received a letter that my processing is delayed because my name check is pending.
Then, later on I went to local immigration office, they told me that my background check is pending.
I asked immediately that is my name check clear and the immigration officer said, background and name check are the same checks.

This is what I have been told. Even I received a response for my SR dated 4 Feb 2008 that my background check is pending, and that is why my case is pending.

I hope that both name and background check are the same, but are interchangeable terms.

Backround checks consist of several checks: FP, IDENT, IBIS, FBI NC. All checks, except NC, are fully electronic, and return results within days, if not hours. The only show stopper is (was?) FBI NC that can take several years. However, if any of other checks uncover something in your background (arrests, illegal presence etc), then additional investigation may be initiated, and that also can take awhile. Normally you should be aware if there are potential "dark spots" in your background and be prepared to extended checks. In most cases, "delayed because of background checks" means NC delays. On Feb 4, 2008 service centers weren't yet aware of the new memo regarding NCs, and apparently were still sending standard SR replies.

There will be another controversy 3-5 years from now when people whose name checks were not completed at the time of GC approval apply for naturalization, and they find out that the same old GC name check still isn't completed.

Knowing USCIS, they will wait for the old name check to clear, then order a second name check for the naturalization itself, rather than being satisfied with just one name check being completed after the naturalization application.

I am in the same boat. For months, my senator's office has been saying that may name check is clear, but security checks are pending. I don't know what that means. I have been trying to get more info on the security checks, but have had no luck. This is really frustrating. I don't have any records of arrests, illegal presence etc.

They may use different names for the same thing.
Generally speaking your status is:

Sometime at the end of 2004 they sent your case data to FBI and did not get the response from them to their request yet.

I believe so, but not now, you will have to wait when your PD is current.
I see you have EB3 India with PD 07/02.

They pull out your case only when your PD is current.
 
My I-485 was approved on Feb 6, 2008, after I filed a WOM law suit in Dec 2007. Back in October 2007 I wrote a letter to the First Lady about my name check status. Yesterday I got a reply from FBI dated February 15 which said: "A review of the FBI's Name Check Program database revealed that your request was received from the United States Citizenship and Immigration Services on November 26, 2004, and is currently in process". It looks like my I-485 was approved without name check being completed if it was still not completed on Feb 15 as the letter says.
