Name Change??? My husband will take my last name

I know it's very "untraditional" but my fiance will be taking my last name (I am the bride) instead of me taking his when we marry. He's always hated his last name and planned on changing it once his father passed. But since we're getting married and we both love my last name and his mother and my family approves he decided to change it to mines. Our problem is how will this effect his AOS application? We plan on changing his last name on the marriage certificate when we wed or should be wait until after he recieves his GC to change it. If we write his "new" name on the application will we have problems.

You must be serving some special kool aid.:cool: The plan is to prevent any complications. Both options are fine however if you go with option I, I might suggest he updates all his other documentation i.e. drivers license, SS number for consistency before you guys apply for the adjustment of status.

Hahahahahahaha. If you knew my fiance's last name you would chose my name too.
He doesn't have a license just his passport and visa, oh yeah and the social they gave him when he applied. He's here on a H2B visa. Should we go to the social security office after we get married and change the name on his social. Do we have to change the name on his passport as well?
 
I would recommend you go to the SS Office and get a corrected name on his SS after the marriage and then wait for the corructed SS card before applying. No need to change the name on his passport until it is expiring and time to renew it.

Just did some research and found out. The state of texas doesn't legally allow a man to change his last name to his wifes (of course they don't) so now i have a new question. How should we go about legally changing his name? Should we do it before or after the AOS. Will have problems if we both have different last name's?
 
Texas, still stuck in the stone age conservative mentality huh? In that case I recommend you go through the process, finish it, then he legally changes his name to your last name through the normal legal channels. Will cost a little more but then there is no other option.

I don't know how long the name change process takes in your neck of the woods however I suggest he does so after the AOS since your. Once again the idea is not to introduce any new variables into the AOS process.

They allow name changes like that, just not as part of marriage. There is a separate local court process that will allow him to change his name to whatever he wants. However, the court probably will only accept permanent residents and US citizens for that process, so he'll have to wait until after he has the green card.

Contact your City Hall for information about the name change process in your area.

It's not a problem to have different last names for the green card process.

I got married in Hawaii, when we were in registerer office the registerer told us Groom can take on Bride last name.

It probably won't help much, but one could probably sue and get this overturned. Allowing females to change their last name for free but not males is pretty blatantly unconstitutional.

Yes, that has actually been done successfully in another state. But the lawsuit probably won't be resolved before his green card is approved, so even if he tries that he'll still be stuck with his current name during the green card process.

And even if that lawsuit succeeds, there may be fight after fight with other government agencies and businesses who won't accept the marriage certificate as evidence of his name change, unless something on the certificate or related paperwork explicitly states the groom's name change from ___ to ___.
