My spouse is out of country. But eligible to submit N400 application based on 5 year rule. Can she sign the N400 (when she is out of country) application and I mail it from here? She can come here for finger printing.

Please advice.

Thanks,
BLR

If she's out of country on a short trip she can sign the application and mail it or have you mail it.

She is out of the country from 08/2009 to 01/2010. She came back to USA before the 6 months limit and left after a month of stay (in Feb 2010). Her bank account, credit cards etc are here for physical presence. She would visit US again before the next 6 months. She has fulfilled continous residence requirement (more than 30 months of stay out of 60 months). Is it necessry for her to come back for submitting N400 or mail it from out of the county? Please advice.

Ouch.

You obviously don't understand what physical presence means.

Visit?

Her interview should be interesting.

Completely agree with The real canadian. Read the guide to naturalization. Specifically Physical Presence and Continuous Residence.

A back and forth pattern of trips under 6 months is often seen as a presumption to break continuous residency. Having her send in application now would be very risky. Even once she returns to US for good, she can still be expected to be questioned about those long trips.

Btw, you have mixed up continuous residency and physical presence. Physical presence requirement is at least 30 months in US, whereas continuous residence is required for at least 5 years prior ro applying.
