N-400 while working overseas

Howdy,

I need some advices and guidance to my somewhat complicated situation.

Some information:
Filed N-400 in April of 2008
Waiting for new FP date

I work for a US corporation overseas on rotation schedule; I do 45 days overseas and 30 days in the states... until last month when my wife and kids had to move to Canada. This time when I return to the states I will stay only for 2 or 3 days then spend the rest of the month with my family in Canada.

My question is, if I continue this travel pattern leading up to my interview, do you all think this will cause me any trouble in getting my citizenship? The only reason my wife moved to Canada is because she cannot remain in the states legally.

Thanks in advance

Do you have an approved N-470?

With your family living in Canada its going to be quite difficult to continue demonstrating strong ties to the US. An N-470 would save you that trouble, otherwise its hard to say what might happen at interview.

Without an N-470, what you're doing is a recipe for denial, and possibly loss of your green card if it goes on for much longer.

It wouldn't be so bad if his family was in Canada but he was spending substantial amounts of his time in the US, as that is often the case with people who have noncitizen spouses waiting outside the country. The problem is that not only his spouse and children are in Canada, but Canada is where he's spending the bulk of his time when he's not abroad working for the employer.

To minimize the chances of denial, he should continue to spend those 30 day periods in the US and bring over his wife and kids to the US during that time, rather than spending 27 or 28 days in Canada.

Re:N400 while working overseas

Thank you for the response.

So if I ask to be transfered back to the states and visit my family once every month in Canada for few days that will not cause any problem?"

Thanks.

You mean cycles of something like work 45 days overseas, return to the US for 23 days, visit your family in Canada for 7 days, then off again to work for 45 days? That should be OK, but be prepared to answer questions about why your family is in Canada and if/when they plan to return to the US to live.

I will transfer my job back to the US work 25 days a month and take 2 or 3 days a month to visit my family in Canada.
