N-400 form - Have a DUI - how to fill the part 10. D -- Please Help!

Hello,

I had a DUI in 2005, I pleaded guilty, and my licence was suspended for a month. I was given a two year probation. Was let go in few hours. Had to take a class later and was given one day of community service.

How do I fill the part 10. D, please advice. Very confused with question2,3,and 4.

Where do I say YES and No to the following questions

1. Have you ever committed a crime or offense for which you were not arrested. Yes or No?
2. Have you been ever arrested, cited, or detained, by a law enforcement officer for any reason? Yes or No
3. Have you ever been charged with committing a crime or offense. Yes or No?
4. Have you ever been convicted of a crime or offense? Yes or No
5. Have you even been place in an alternative sentencing or a rehabilitative program. Yes or No
6. Have you ever received a suspended sentence, been placed on probation, or been paroled? Yes or No
7. Have you even been jailed in prison?

Are you only confused with questions 2,3,4? You were detained, convicted of a DUI and had probation so you would answer YES to questions 2,3 4.

A simple DUI is not considered a CIMT, however if your BAC was above a certain level it could be considered aggravated DUI which is a CIMT and precludes you from demonstrating GMC.

You'll need to provide certified court documents at your interview, but before you apply make sure your DUI is not a considered a CIMT.
 
CIMT means crime involving moral turpitude. You'll have to find out what your BAC was and what the laws in your states are in order to determine if it is a CIMT.
