N-400 Early Filing Pitfalls

There is a variation of N400 application processing times (from filing date and Interview Date).

In some cases it has taken over 90 days and some cases are processed in as little as 58 days.

1)What happens if your Interview is scheduled before your GC anniversary date?

2)Is it better to submit N-400 within 60 day period of GC anniversary instead of 90 days?

3)Is your Interview and Oath conducted same day?

Appreciate your feedback.

Thanks!

1. You cannot file in your N-400 before the completion of the 5 or 3 yr anniversary of the GC. If you file so, then the application will get rejected.
2. Submit the N-400 well after the 90 day period so that it does not get rejected
3. Many USCIS offices have the interview and the oath on the same day. There are some which do not have. So it all depends on your local
USCIS offce.

Good Luck with the process.

You can file 90 days before the 5 year anniversary, as you point out. If the interview occurs prior to the 5 year date, a decision cannot be made.
