My wife did not received an updated/new i94 along with my TN extension? Her TD visa is valid for another 24 days from my previous TN

Hello All
I am a Canadian citizen and i went to Laredo POE, TX on July 30th along with my wife to apply for a new TN (current one expires on August 24th, 2024). My wife who has Indian passport has another 24 days of TD visa from my previous TN. We walked to the mexico side via bridge number 1 and came back to the US side. My TN was approved but the officer refused to issue a new I-94 for my wife. Based on the information i read on this forum i believe my wife should have received a new I-94 based on my new TN . He said my only option is to do the I-539 once i get back to US and they dont issue new I-94's anymore. Did anything change in that regard or the officer was ignorant? Appreciate your replies and suggestion's.

From my understanding only Canadian citizens/Canadian passport are eligible to apply @ the POE.
 
What is the expiry date of her consular visa stamp? And when does her Indian passport expire? This may have been a factor in his refusal.

Non-Cdns can and should get I-94s at the border if otherwise eligible. The officer (and wutang2) was incorrect. You could try to go to a local office to fix this, but her only other option is to file an I-539 based on your new TN. This will keep her in status while waiting for approval.
 
Thanks Nelsona. Her visa stamp expiry date is August 24/ 2024. Her passport expiry date is 01/13/2026.
Should I try another border crossing if the local cbp does not fix it?
 
You could, if you go before the 24th. To be clear, you are saying that her current I-94 and her consular visa have the same expiry date?
 
Yes, that is correct. Her I94 is updated that we crossed the border on July 30th her but expiration date still shows August 24/ 2024.

Any possible suggestions on border crossing's apart from laredo in Texas?
 
A follow up: I went to CBP San antonio and got my wife's I 94 updated. The officer i talked understood the issue and made the change. Thanks Nelsona for your help and advice.
