Hi,
I came to US on H1B in Oct 2000 and visa expiration date and date on I94 was Oct 2003. Got My H1B transferred to another employer and got new I 94 with expiration date of oct 2005. In my next H1b transfer my new date was Oct 2006. After this I got my visa transferred again and before the approval I went to India with the receipt from INS indicating that I have filed H1B transfer. However when i returned the immigration officer put a I -94 with expiration date as that on the Visa. I now have a new H1B approval with expiration date 0f Oct 2005. Does it creates any issues that my Passport has an I94 with expiration dates from First H1B on which I came to USA.

Thanks

Date on the latest I-94 decides your authorized stay, whether obtained at port of entry or as a part of H1 approval. If your approval was done after you entered US, the date on the approval will hold.

the latest i94 overides all the previous ones.

Did you get a i94 with the latest h1b approval ?
if so then that is your latest i94. (means no problem till the h1b expiry date)

If you did not get one then before the expiry date of i94(passport)
you have to go out (usa) and come back to get a new i94.

Thanks Guys,
I appreciate such a quick response. I actually got my H1 approved after I came back to US and got a new I 94.

You need to fix the I94 problem. Without a quick fix on the I94, your I94 that came with h1 approval is no longer valid. Go and get a new I94 based on the approval from the nearest POE . search for I94 problem in archives..

-- When did you enter US and got I-94? Note the date

--Check the H1 approval date if it was approved by BCIS after you entered US and new I-94 was attached, you don’t have any problems to fix your I-94, the latest I-94 that you got attached with H1 approval that is OK,
