My mother is american, can she sponsor her son.

Hi,
I just had a question regarding citizenship sponsor to my brother by my mother. My mother has got a US citizenship. Can she sponsor any kind of visa or citizenship for her son (which is my brother) ?

If yes, what are the steps involved in doing so ?
If no, what are the reasons?

I am also a US citizen and I just want to know which of the following is a better option;

Me(I am a citizen) sponsoring green card to my brother ?
My mother(she is a citizen too) sponsoring green card to her son ?

Which one has better chances and faster time of processing ?

I think the process would take 15 years or more. You should ask the question in the family immigration forum. I'm sure you'll get more details there.

Either you or your mom can sponsor your brother.
The priority dates of family-based immigrant visas can be found at http://travel.state.gov/visa/frvi/bulletin/bulletin_4805.html (as of May 2010).

Since your brother is 42 years old, if your mother sponsors unmarried son, use 2B preference or if your mother sponsors married son, use 3rd preference. If you sponsor your brother, use 4th preference.

Chargeability Area is your brother's country of birth so you can determine how long it will take to get a green card for your brother.

You mentioned specifying the 2nd, 3rd and 4th preferences. Can you please mentioned where should I specify them,I mean in which application form?
Does it mean that 2nd preference is faster than 3rd and 3rd is faster than 4th preferences? or is it the other way round?

I am wrong.. here's the correction (see red hightlight below):
Note:
"1st" refers to the First Preference in Family-Based Immigration category, i.e., unmarried children of U.S. citizens over age of 21;

"2A" refers to the first subcategory of the Second Preference in Family-Based Immigration category, i.e., spouses or unmarried children under age 21 of permanent residents;

"2B" refers to the second subcategory of the Second Preference in Family-Based Immigration category, i.e., unmarried children of 21 years of age or older of permanent residents;

"3rd" refers to the Third Preference in Family-Based Immigration category, i.e., married children of U.S. citizens;

"4th" refers to the Fourth Preference in Family-Based Immigration category, i.e., brothers and sisters of U.S. citizens.

Immediate family members of U.S. citizens, i.e., spouses, parents and unmarried children under age of 21, are not subject to the numerical restriction of visa quotas.

so go to visa bulletin: if your brother was born in India (42 years old is not married) and your mother sponsors him for a green card, it would be 1st preference. It will take 6 years to get a green card.

Did you see 08SEP04 for India of 1st preference? It means they started right now to process the applications for applicants who have applied in Sept 8, 2004. so 1st is faster than 2nd.

This is not quite right. Category 2B is for children of permanent residents. The OP stated that his mother is a U.S. citizen. So if she sponsors her son, it would go either under the First preference category (if the son is over 21 and unmarried) or the Third preference category (if the son is married).

I would say that it is better if the OP's mother sponsors his brother rather than if the OP sponsors his brother himself. The priority dates for the Fourth preference category (brothers and sisters of U.S. citizens) involve a longer wait. Plus if the Congress does get around to passing any kind of an immigration reform this year, it is quite possible that the Fourth preference category will be eliminated altogether.
