my husband, us citizen, didnt pay child support

Hi, everyone!
I think my question is of legal nature,but if anybody had a similar situation or knows something about it, please share your experience.
I got married to a us citizen,this is my first marrige and his second, my husband has a child from his first marrige, in the decree of devorce it says he's adjudged to montlhy payments for the child's care.He failed to do so, the child's mother never pursued him for that and still doesnt, since her own income is significantly bigger than his. Now i'm wondering if INS will have problems with that, when he applies for a green card for me, i assume they can ask to pay for all the years he didnt pay, he can't do it at the moment, so what do we then? Can he sign up for some sort of payment plan? Does one exist at all.

it should not be an issue with USCIS, unless his former wife reports it to Child Support. the Child Support group will then contact your spouse for the due payments and if he is unable to pay, they will try to work-out (payment plans, garnish his wages, etc). if this happens, it will impact the I-864 that he has filed for you.

Note: I am not a lawyer, the information above is based on my previous experience with Child Support. It may or may not be correct, based on the State you reside.
 
Thank you very much for the information.So as long as his former wife doesn't report, we are o.k, but what if she will one day? The I-864 is gonna be effected even if we have a joint sponsor(his father) Are they gonna revoke my GC in this case?,we reside in Washington DC and his exwife is in Taxes.

your GC (aka permanent residency) has nothing to do with your husband's child support obligation and/or non-payment thereof.
 
Is going to be only one wish probable no related to you . Your husband will not be able to visit your country because now the United States does not give or renew passport of parents that do not pay child support. Until he pays the bill We can not have a passport. That will not affect your application I presume

once you get your GC, his child-support case has nothing to do with you. the only time it can create an issue is while your GC is still in process.

regarding your affidavit of support, if you have other financial supporters (his father, as you suggested in your previous post) or if you are earning yourself, it will make it a lot easier on that front. if you feel finances are going to be an issue, you may add additional supporters (his/your relatives, etc).
 
Thanks for the replay. You mentioned, i can even show my own income,I do have one, but i thought, my won't count since i wasn't supposed to be working at all, though i worked on my own social security number and paid taxes since my first day in America.
