I am a Filipina married to an Indonesian with F3 visa. Do you think we will not have any problem with this once my husband's petition approved? He (my husband) assured me that it will not be a problem but I just want to make sure that is why I am asking this question. Thank you very much.

Hi babes_lane! Can you please be more specific? Not have any problem with what?

sorry, i was not too specific. what i mean is problem with the petition. we didn't notify the NVC about me being Filipina tho not sure if it's relevant. my mother-in-law just upgrade her petition to my husband from F2B to F3. I am only worried about me being a filipino citizen because I know that filipino and mexican are way far when it comes to priority dates.

No worries. Cross-chargeability means that you can claim whichever country of birth (yours or your spouse's) that is most advantageous.

Thank you very much Sir/Madam (TheRealCanadian) this helps me a lot (I was the one worrying but my husband was confident) ohhh well.. just want to hear/clear it from others :-)

What did you mother-in-law put as your "country of birth" in your husband's I-130 form, question C.17?

the I 130 was filed long time ago when her son (now my husband) was still single. What I know is that they only notify NVC of my husband's change status and her citizenship being approved. SO i was not included in the I 130 form. Does my mother-in-law needs to file another I 130 for us?

When did you get married? Before or after your mother-in-law's naturalisation?
