My fiance J-1 overstay w/2 yr hrr - Please help

Expired passport:
The embassy migh not renew expired passport because she is out of status. (but we will try). Otherwise as far as we know, she can get back home. She can ask the embassy to issue a temporary travel document.
 
We got one messed up case for sure.
We were speaking with a guy who tried to renew his expired passport, but it got confiscated by the consulate. So no i guess she really has to go back.
I read several threads on it but it is not clear, do people get waivers when they are back home?

some do, but the procedure is different, since she wouldn't be getting her no-objection letter from the consulate. I wouldn't even know where to go.
 
I think she will be able to get the no objection letter. From then on is it the same process in terms of working with DOS and USCIS?
