My EAD renewal denied .. Please Help.

Hi,

My EAD renewal denied for the following reason.




Upon consideration ,it is ordered that your form I-765,application for Employment Authorization ,filed on
3/2/2009,pursuant to Title 8 Code of federal Regulations 274a.12(c)(9) be denied for the following reason.

Title 8 CFR 274a.12(a)(1) states in pertinent part : " The application shall be submitted no earlier than 150 days
after the date on which a complete application...has been received..." Title 8 CFR 208.7(a)(2) also states, "
Employment Authorization may be granted according to the provision of section 208.7 of this chapter in increments to
be determined by commissioner and shall expire on a specific date." Renewal of the Employment Authorization card are
not authorized 120 days prior to the expiration date of the current EAD card issued.

There is no appeal to this decision. You may file a motion to reopen or a motion to reconsider under Title 8 code of
Federal regulations,part 103.5.A motion to reopen or a reconsider an application must be filed with the proper fee
within 30 days of the decision. The decision is without prejudice to consideration of subsequent application filed
with the proper U.S .Citizenship and Immigration services office.

What is the procedure to re apply ? Do I need to fillout Form-765 and attach all documnets again ?

My EAD expiration : 08/07/2009.

What should I mention in question 11 results field on Form 765 ?
 
In Deniel letter USCIS mentioned to file motion to reopen or a motion to reconsider within 30 days of the decision(decision date : 03/11/2009).

Should I file to reopen within 30 days or Can file new application any time ?

You can't file an MTR, because USCIS did not make an error when they denied your appliaction.

File a new application less than 120 days before your EAD expires. Didn't you read the denial notice?

What should I mention in question 11 previous EAD results (Granted or denied) field on Form 765 ?
