My checklist, and a few questions about filing?

I want send out my package tommorow morning so please tell if i'm missing anything.

Also I live in California, so do i file at the California service center or still mail everything to the USCIS Lockbox?

Are personal checks fine? and do I make all out to DHS?


My checklist:

Form I-130:
- Form completed, dated and signed.
- Attached on personal check for $190
- One passport picture of myself and one of my wife
- Copy of marriage certificate
- Copy of my passport, I-94, and F1 visa
- Copy of my wife’s passport

Form I-485:
- Form completed, dated and signed
- Attached personal check for $395 (incl. biometric fees)
- Two passport photos
- Copy of my passport, I-94, F1 visa
- Copy of SSN card
- Copy of I-20
- Copy of Birth Cert.
- Copy of marriage license and cert.

Form G-325 Biographic information

Form 693 Medical in sealed envelope

Form I-765:
- Form completed, dated, and signed
- Copy of my old EAD, back and front
- Copy of passport, I94, and F1visa
- Personal Check for $180

Form I-864 Aff. Of Sup.:
- Form completed, dated, and signed
- Copy of W-2 forms for last 3 years
- Copt of 1040 for last 3 years
- Copy of most recent pay stub
- Copy of my wife’s passport

Do you mean you have 2 G-325's,one for wife and one for you?


Sponsor/petitioner will need an employment letter verifying date hired, salary, job position, and salary/wages on company/business letterhead or stamp. If you don't mail it with original submission you will get and RFE(Request for Evidence) and it cause a delay in your processing. I KNOW IT SOUNDS REDUNDANT BUT THEY WILL REQUEST IT.


Make sure you have copies of your original submission.

Yes I have 2x G-325, one for me and one for my wife.

Thanks for the heads up about getting an employment letter. Will I still get an RFE if I sent in my package tomorrow, and send in the emplyment letter in say like 3 days?

And I definitely have copies of my forms!!

Yes I think you will cause when you send additional info, it needs to be accompanied by some type of letter or form from USCIS. I know you are anxious to get it in the mail but 3 days will possibly save 30- 60 days in this process. I am sure someone else will respond to your post as well with their expertise/experience.

I thought we had everything, but alas :o , got the RFE for guess what??? Yep, :p the employment letter. :p Hang tough!!

It is G-325A, not G-325!
And, try to send everything together, in the same package. This is CIS we're talking about. They are pros in messing things up. You don't want to take a chance, do you? :D

Its a good idea to include this I agree, for completeness. HOWEVER.... its not required and not submitting it will not guarantee a RFE at all as you suggest. I know this from personal experience having submitted the I-864 with just the 2005 tax return and nothing else.
 
RFE : I-864 for my parents AOS

Both my parents got RFE's for I-485 application. We submitted all the required documentation for I-864 in the initial submission...But still got the RFE.

I sent the following documents again..

§ Current Employment Letter as evidence of present employment of Sponsor
§ Year2005 Federal Income Tax Return and W-2s of Sponsor
§ Year2004 Federal Income Tax Return and W-2s of Sponsor
§ Year2003 Federal Income Tax Return and W-2s of Sponsor
§ Pay stubs from employer from past 6 months of Sponsor
§ Copies of recent bank statements of Sponsor

I'm not saying that its possible to get an RFE if you don't submit the "extra evidence". I'm just saying that you aren't guaranteed an RFE if you don't.

Honestly it seemed that about 4-5 months ago when they changed the requirement from 3 years tax return, employment letter and payslips to just the last tax return, a lot of people get RFEs for the other stuff. I would put this down more to the USCIS employees "not getting the memo" than anything else. Especially as it would seem from my monitoring of this and other forums, that the number of RFEs for extra financial information as significantly dropped in the last 2-3 months.

Are photo's required for I-130 for parents? Please confirm, I am about to mail to lock box for parents.
I know 2 pictures for I-485.

Thanks for the heads up about the employment letter. I am pretty sure we did not send an employment letter from my wife's employer along with my paperwork. This did not trigger an RFE but it is on the checklist that USCIS sent on my interview notice. We'll make sure we have it.

Why the hell they scheduled you for an interview in March 07? Man, someone
in VA USCIS is smoking weed... :eek: That's far in the future... :cool: At least a date in Jan is nearer... :mad:

That's basically five months from the filing date. From what I have seen most are done in 3-7 months so this really seems kind of average to me. I also never see anyone else here at Norfolk VA so I have little to compare to.

I REALLY hope my EAD comes soon my TN expires on 01/26/07. It SHOULD....maybe I should give them a buzz.

Well... I understand, but to wait that long, I know you are working and all is cool, but this slow moving process is criminal... :rolleyes: I wonder what the hell they are doing.... :mad: Unless they are designing an interogation room for all couples... :p As I said, if you are patient, then all the best.. :p I didn't know that norfolk is that slow... :o

I live in the tri-state of DC, VA & MD, so I am used to the slow moving process of Northern VA, especially with all the corruption and crimes that USCIS officials are committing these days in VA... :mad: Man...I can't wait to prosecute people like these... :rolleyes: send them to jail for a long time...
 
5 months is a very short waiting period. I waited for 14 months, and I thought it was below average (ATL).
