Multiple H1B Applications.

Hi friends,

An employer applied my H1B in July 2004 . Another employer approched me recently & i have succeded the interview & he is interested to apply my H1B.


Would it be a problem if both the employers apply for my H1B at the same time (or duing the same period) ...????

---- please post if this question is for first time H1B petition and you are out of USA
or you are in US and asking about H1 transfer

----- no problem, you need to work with employer in US whose H1B petition approval you take to US consulate for H1 stamping.

I appreciate if you could answer the below questions...

My wife's visa has been recently transferred from H4 to H1(under premium processing) and this new H1 is valid from Oct 1 2004. But my wife found another employer who offered a better position than the first employer and this second employer has also agreed to apply for H1 visa.

Questions:

1) Is it possible to transfer H1 visa without actually working for the first employer. Note that first employer 's H1 visa is effective from Oct 1 2004. So we don't have any paystubs.

2) or, will it going to be a new H4 to H1 transfer again?

------ I think she needs to work with the employer who filed her H4 to H1B change of status and get 2-3 recent pay stubs then file H1 to H1 transfer with new employer
2) or, will it going to be a new H4 to H1 transfer again?
------ it will be H1 to H1 becase she is on H1 and her H1 is valid from Oct 1 2004. I dont know the correct answer to your situation, others may help you or seek advice from good lawyer
