Multiple H1-B (cap-exempt, non exempt)

Hi,

I am currently on a cap-exempt H1-B visa.

From the info I gathered, I believe that
a) a person can have multiple H1-B visas at a time
b) if you are on a cap-exempt H1-B visa and want to
switch to a commercial organisation, you will need
to get a H1-B visa from the count( I mean, its not
the usual H1-B porting)

please correct me if I am wrong.

If one can have multiple H1-Bs, could you please let me
know if one of them could be a cap-exempt H1-B and another
H1-B which is from the cap?

I am looking at a scenario where I can get a sponsor willing
to apply for a H1-B visa(from next years quota which starts
in october) before october and if possible continue working
on my current visa until the end of this year.

+++++++++++++++If you are on a cap-exempt H-1, you can continue working on that until the cap H-1 kicks in on 1 October. I am not aware of any law that says otherwise.

Thankyou so much for your prompt reply. Sorry for not being clear in my original post, I still have a question unanswered.

I understand that I can continue working on my cap-exempt H1-B
visa until my new H1-B from the cap kicks-in in October2004.

say if company A applies for my H1-B visa now with a start date
in october2004 and get it approved.
My question is, whether I can continue working on my cap-exempt H1-B visa even after october until i decide to make a move to company A.

Say, a person is currently working at an educational institution A (cap-exempt H1B) applies for another H1B visa through a commercial organization B (non-exempt H1B) thereby having multiple H1B's.

(a) Should there be any agreement or understanding between A and B ?

(b) Is there anything like the employee should work at B for atleast a certain period after joining it?

(c) Some time later if the person joins another commercial organization C, how does the H1B transfer work? Does he need to get into the quota again (or not required 'coz he already got into the quota through B)?
