My company is saying they are not going apply for the EAD. They are not offering any reason why...The company is sending the I-485 docs for AOS. Here are my details:

1. H1 Expiring in March 2002. Extension approved for 1 year.

Here\'s my question:
1. After 6 months if I am laid off, can I gain another employment without the EAD.
2. Can I file for the EAD on my own...Will I have a problem with the INS...

any info would be immensely appreciated...

485 is filed by you for AOS, not by your company.

I am not an attorney, but I feel you can apply EAD on your own. Even 485 is applied by you only, through your /your comapny\'s attorney. Only thing is your employer\'s coopertaion is needed atleast for 180 days from your RD.

Just this is my opinion only and Mr.Jim is the best to give a suggestion. Good Luck.
