Mother's Visa Got Rejected. Please Help !!!

My mother, whose is a widow (My father passed away in 1998) went for a B2 Visitor Visa on November 29, 2004 at chennai and got rejected on clause Section 214(b). I am the only son. They did not even ask any documents sent by me except the DS 156. They asked the following questions to my mom:

1. Who is there is USA (Answer by my mother: My Son)
2. Do you have any other children (Answer by my mother:No)
3. What is your Husband doing (Answer by my mother: He is no more)
4. Do you get pension (Answer by my mother:Yes, 3000 Rs)
5. Do you have any other source of income ( Answer by my mother:I am a Government employee working at BSNL and I have 4 more years of service.)

Note: She was not able to show the Bank documents, house property, Bank balance, House rental income which she had.

Thats it. My mother's visa got rejected. This is the situation for me right now.

My questions are

1. What would be the reason for rejection. If they think, that she is potential immigrant, because I am the only son and she is a widow, is there anything I could do to change the situation.

2. Is there any processs where I can ask for a re-evaluation. If so, what is the procedure? Would it be better, if I send any document or letter.

3. If there is no reevaluation procedure, when is the right time to appear for the second time. Would it be a problem, if she appears in a month again.

4. What are the strengths and weaknesse's of the case.

5. I found that Shela Murhty has started a consulting service in India and there is an attorney called Senthil. I was wondering how will the chance of getting the visa will improve if I go thorough the attorney. I found out that the fee for the consulting is 15,000 Rs. I just wanted to make sure it's effectiveness if it's going to improve the chance. Please let me know if some one has already consulted with them or with any other Attorney.

6. Is it possible to appeal the decision made by the consular officer regarding my mother's B1/B2 Visa. My mother got rejected under clause 214B. If re appealing is possible, how successful will it be and if rejected for re-appealing, will it have an effect on my mother's interview during the second time.

It would be a very great help if you could answer these questions and educate me. I am really very much pressurized for her visa being rejected and this happens the second time, it will be very hard on me and my mom.

I too consulted the same Murthy's Lawyer Senthil at Chennai office as my in-laws B2 visa got rejected (more than 3 times under 214B), just few weeks back, he asked Rs 5000 as consulation fee. I was wondering how come the lawyer is asking Rs 15000 to u for the same purpose. So the lawyers are taking advantage of our cases and demanding more.
He also said that it is not possible to go thru legally. B2 is a non-immigration visa and is at the discretion of the officer and there is very less chance to go thru legally.

Non immigrant visa (B), agents (attorney) can not help to get it.

Your case is obivious that your mother can abandon home country because no immediate blood relatives (ties) are there.

What is your status in US. Only possible way is immigrant visa through you.
 
I am working in H1B right now. I am not sure whether immigrant visa would go through. I have been working only for the past 6 months. Do you think, it's hard to get the visa the second time if my mom shows documents like
1. Her work status in India, 'cos she is working in Government office.
2. If she can get a letter from her higher authorities that she is a very crucial member.
3. Mother in law who is totally dependant on her.

Nothing wrong in trying second tiem. Let her get letter from her employer.
But chances not favorable.

bringing her throug immigration may take quite some time (min 8 to 10 years). 3 to 4 yrs to get your GC and citizenship and sponser your mother. Long way to go through your employment. If yu are goin g to marry a USC then it will be 4 to 5 Years.

----------Does it mean she did not give copies of these documents to Consulate. These documents could have been a proof of her ties with the country.
 
How do they arrange translator/Interpreter service for the person not fluent in English? Do they ask translator/Interpreter service when forms are submitted at the consulate?
 
No she had all the documents, but they did not ask her and hence she couldn't show them. I have a question

My mothers visa got rejected under section 214(B) at chennai consulate on Nov 29. I have booked for an appointment on Jan 10. I was just wondering what would be best time gap to apear again. Is one and half months sufficient for applying again. Is there any advantage if I wait for more months say 6 months, for appearing 2nd time. Please advise me on this.
 
Lawyer's help for B2 visa

Hi Vijay and Krson. I too had a problem with the B2 visa of my mother - She was denied twice earlier. I went to the same lawfirm and lawyer u r refering to. They helped my mother get B2 visa. About the fee - they were very clear - They mentioned that Rs. 5000 was for the first consultation only and the total fee for the case depended upon the number of time someone was refused and that it varied from case to case. this is the 15,000 you maybe refering to. I was very impressed with their service and the fact that they were being clear about the fee (no hidden charges) and not promising success upfront like some others do! I fell it was worth spending every cent on hirining these guys! I guess Krson may have had some communication gap with the lawyer!

Her financial ties to home country is important. Try to get her property, Bank balances, FDR, Post office FDs, Pension documents , house, land. ever ornaments (everything even minor ones) evaluated by a chartered accountant. The accountant will make a single or two page document about it. Hopefully that will show that your mother is financially independent.
This is from my experience where my mothers visa was put on hold (not rejected) and asked her to show financial documents. When she went with the documents, she had no problem.
Maybe also ask her to take some documentation from her office.
