More Denials for CSAs?

I was just denied my 4th TN last week and was told that they're cracking down on Computer Systems Analysts. Has anyone heard about this?

I had the same letter as the previous years, and said basically the same things. I've always been told to stress the analysis part of my job, and that's what I was doing. After an hour of being grilled about it, I was told that I no longer qualify, but they would not tell my why. They also said that they've been getting pressure from higher up to deny more CSAs. Then they told me that if I applied at another port, I would be banned for 5 years for fraud.

Is there anything I can do?
 
Get the reason you were denied, and address that reason in your next attempt -- at the same port. You may need legal representation.

Or, apply by mail.
 
They wouldn't tell my why. I asked and they said that they couldn't (or wouldn't) give me the reason.
 
That's why I feel you may need legal representation. They can't deny you entry for no reason.

But, I question why you simply accepted this. They would have to have told you something. Was the job not correct, were your quals not correct. There has been no change to the NAFTA regs on any of this. They need to point out where your request was is deficient.
 
This is very disturbing. Many Canadians who are on TN are in CSA category. US needs a lot of IT professionals. Why do they want to deny more CSAs? More imporantly, when they deny your entry, they are supposed to put the specific reason in writing. You have a right to know why exactly they denied you. If what happened to the poster really becomes a general trend, it really makes US very unfriendly to Canadian IT professionals.
 
Unless I missed that, where were you denied, what POE?

I was denied in Blaine, WA.

The really disturbing part to me wasn't that I was denied (I thought it was bound to happen at some point), but that they wouldn't tell me why they were denying me.

Legal representation is out of the question at this point as my job has been given away already.

Great, that's exactly where I got my two TNs in the past. It was supposed to be a good POE for TN applicants. So what do you think why they denied you? What exactly is your job and your qualification?

I have a BCS and described my job as follows:

- Gather requirements from users
- write functional spec from requirements
- write technical spec from functional spec
- determine if any hardware or architecture changes need to be made
- assist other developers in the coding
- assist other developers in testing

Does this sound like it doesn't match the CSA job description?
 
That sounds just like what the Occupational Outlook Handbook describes. You have a bachelor degree in computer science. I don't see any reason for denial. If you don't qualify for TN, I don't see who does. The fact that they denied your entry without telling you why and threatend 5 years ban if you try at another POE is very sketchy. My only logical reason is the officer you encountered might not be having a good day and would have denied anyone who applied for TN. What you should have done is demand for the reason for denial. If the officer wouldn't give it to you, get his supervisor involved and present your application material directly to his supervisor. When I applied for my last TN at the same POE, the officer was going to deny me until he consulted his supervisor and his supervisor decided to give me the TN.
 
I actually dealt with three guys that day. The first one was very junior and didn't really know what he was doing, and passed me along to another guy after 15 minutes or so. The second guy asked for help from the senior guy and they both worked through my application together. They spent at least an hour on it, and seemed to be looking for any reason to deny me.

It wasn't a particularly busy day, and they didn't sound like they were having a bad day.
 
One other thing to add. If you get denied at the Peace Arch crossing, DO NOT go to the Blaine (SR520?) crossing. They share CPBs and you are likely to run into the same guy.

Well, as you should know by the warnig you got, you shouldn't ever go POE shopping once denied. Fix and return is the motto.

I think you mean the Blaine Truck Crossing about 5 - 10 minutes east of Peach Arch.
BC/WA border is cracking down on ANY TN's since Spring '08 I'm an earlier victim from Nov. 08.
Welcome back to Canada have you applied for your State Employment Insurance yet?
 
Is it only BC/WA border or the whole country? Why are they cracking down TNs? What did we do to deserve this?
 
Could you think of any other thing about your credentials that could have resulted in that denial? Is your BCS Canadian/US or foreign? A friend of mine went to a border close to Seattle(not sure if it was the same one) a few months back. The visa officer gave him a very hard time, asked him all kinds of job related questions as well as of his academic qualification. They wanted him to bring in all official copies of the documents the next time and a clearer letter. My friend took everything to them the next time and managed to get the 3 year TN in his 2nd attempt.

Back when I was on TN's, I had most officers be nothing but polite and professional. One wasn't, and made all sorts of dubious claims. When I went to another POE, the second officer said the rude fellow was all kinds of wrong. But if I had not checked, I would not have known. it's the attitude that an international treaty is subject to whatever mood the interviewer is in that I found annoying.
 
Jerry is right, it only takes one who takes it upon himself to make TN denials his crusade. It can infect a POE, or as in this instance a whole regional division.
