Mom & little sister on B-Visa, can sis attend Middle-School for 6 months w/I-94 ?

Hello there,

My mother and sister are here in the US. They came in with a Tourist visa and got their I-94 and Passport stamped for 6 months, which means they can stay here until January, 2008.

They originally came only for vacations, but now, since they got the I-94 until Jan. they are thinking about staying. The thing is, that if they stay, my sister would have to attend school here, Middle-School, for her no to miss all those classes.

We already found out in our home country, that it is possible for her to transfer in January to a Middle-School back home, all she needs are her grades from here.

The question is; is it legal or illegal to attend a Public Middle-School here in the US while on a Tourist visa? Because my mother already asked the school about it, and they don't ask for any Passport, or proof of status, or anything, all they ask for was medical records. (This is in Florida)

And if it is legal, or illegal, where can I find this information online, like so that I could download and print from an official website, maybe somewhere where they list rules, regulations, laws, etc. so that I can give to my mother so that she knows for sure that this is a possibility.

I know that you are right. And from the government stand point I would think, why should we (tax payers) pay for foreigners Education expenses, specially when is just a temporary thing? But, how do hundreds of illegal immigrants children (not born here) attend school then? just want to know what you think of that?
 
most schools let you attend without problem but it varies by school system. and it is legal to study on an incidental basis on B1/2. The idea being that the purpose of visit was tourism not education.

I read the information in this link, but they are talking about F1 visas in here, I am wondering about B1/B2 Tourist visas. Is there any where that I can get this information online, I am trying to prove that I am right to my mother, I am telling her my sister cannot attend school here. So if there is any where that I can print this "law" please let me know, because the information in this particular site does not pertain to B1/B2 visas.

Also, I understand he school didn't ask for any proof of being resident, or citizen. So my mom's argument is that, if it was illegal, then why don't they ask for such proof.

So, would this apply to my sister, because they came here just for vacation, but my mom wants to stay until January, but she can't leave my sister alone back at home, and she doesn't want her to miss classes.

Not for the last half-decade. In fact, you cannot even file a COS from B to F status without declaring your intent to do so at the POE and having your I-94 annotated as such by the inspecting officer.

The only question is whether this prohibition extends to elementary schools.
 
This cannot be F status as this is not college but middle school. So she will not change status to F, that is a completely diffrent scenario and you are right about that.

My suggestion contact a lawyer to keep things above board
