Mistake in my Date of Birth

seeya

Registered Users (C)
hello everyone.
I am a 2009 dvlottery winner with CN: 2009AS00008xxx. I have a problem with my birth date.
My real birth date is about 5 month different from my officially registered birth date in my birth certificate and other official documents. My parents have done that to make it possible to send me to school one year earlier. it was a regular action in those years in my country.
Now the problem is, by mistake, I entered my real birth date in online registration for lottery which is not my official birth date.
So, I entered my official birth date in ds-230 and sent it to KCC.
Now, I figured out that they are very sensitive about information of online registration.
How can I prove that it was just a mistake?
Is there any chance for me to get the Visa?
Is it useful for me to get a testimonial from the hospital that I was born in it to prove that my real birth date is really the one I entered on internet registration?

Thank you so much.

PS: I've sent an email to KCC about 2 month ago and told them that my birth date in my internet registration is not correct and the correct one is in DS-230 but I didn't describe the reason above.

Too bad.
What you need to do is to have your birth certificate reissued with the correct date (real one). Then you bring the new birth certificate, the old birth certificate and medical records from the hospital you were born in to the interview, give explanations and the issue is most likely solved.

I cannot reissue my birth certificate, I can only provide medical records from the hospital I was born in it. the difference between my real birth date and my official birth date is about 5 months!
Is there any hope?
Do you know anyone with such a mistake in his/her birth date of electronic visa entry form that have succeeded to get the VISA?

PS: In response to my email to KCC which I sent 2 month ago they told this:

Thank you for your inquiry.

KCC does not have the ability to retrieve or correct the data that was provided on the original entry to the lottery.

Please complete the forms DS 230 Part I, DS 230 Part II, and DSP 122 with the correct information. Once received at KCC, the information will be included in your case file for review.

Then most likely your entry will be disqualified.

, I can only provide medical records from the hospital I was born in it.
Try that. But most likely your entry will be disqualified.

It does not really matter how much the difference is. The problem the date is different.

Is there any hope?
There always exists some hope. You could count on consular mistake, for instance. Also, the only reason they will disqualify your entry is they suspect you sent two entries - with the date in birth certificate and with another date, in order to pass through check for duplicates. Dublicate entries are not allowed. If in the country you live in there is very low demand of people who want to move to US, that might not be a problem at all.

Do you know anyone with such a mistake in his/her birth date of electronic visa entry form that have succeeded to get the VISA?
No. But I know several cases when the entry was disqualified.

Regarding the addition you just added. KCC does not have power to disqualify. They just send the description of potentially disqualifying factors to the consulate together with your case. The consulate makes the disqualifying decision.

Re:

Hi seeya,

I don't have any answer for your question actually but I have a suggestion for you: Don't talk and think about what you can't do because past is past...Do what you can do right now..prepare as much documents as you can to prove your case and focus on the fact that you are not a liar..what is the point of being nervous?

Wish you luck!

Is it better for me not to go to consulate for interview to keep the chance of next years lottery for my self and keep my profile clean( with no rejection )?

But he might be BANNED from entering the US if he attends the interview with FALSE documents. I know of such cases. Be careful on your decisions.

His old birth certificate is not fake. His new birth certificate is not fake too. And his medical records are not.
In that case I do not see any kind of consequences for future lotteries.

Thank you all.
Why they don't say clearly in the rules that mistakes like these will certainly disqualify the case? Why I have to be nervous for many months and spend some money for nothing?
This is not fair...

Especially this one:
KCC has made several improvements to its processing of the DV lottery entries to detect multiple entries and to screen cases for possible fraud indicators before they are sent to consular posts for adjudication.
.....................
In addition to facial recognition software, KCC employees search for other fraud indicators as they collect additional documents from individuals selected in the lottery and prepare to send their cases to posts for adjudication. For example, they note, through “fraud flags,” if applicants (1) added a spouse or children to their case after being selected in the lottery, (2) if there were substantial changes to biographic details, or (3) if the applicant appeared in a different entry with different family members.

Those checks appear upon detecting problems with DV lottery program. Nobody knew from the very beginning what exactly types of fraud would be common for DV lottery and which particular ones should be avoided first.

And another reference.

http://www.wolfsdorf.com/DVarticles/DV 2004 Update.pdf

These instructions are deceptively simple. The DOS, wary of fraud, demands strict compliance. A minor typographical error appears to raise a presumption of fraud because the DOS has concluded that most errors, particularly in the spelling of the name, indicate that duplicate petitions may have been filed. Any differences in the spelling of a name on the petition when compared to the birth certificate will disqualify the applicant. Almost three million applications were disqualified from the DV-2004 program for failure to comply with the instructions.

Thanks raevsky.
But I've not entered duplicate entries and its their weakness of detecting frauds if they reject cases like me with no fraud.
Actually, I will disqualify because of their weak system and its not fair again.

The fraud detection system is not perfect. But they do not have the aim to have an extremely fair system. What they need is to have a system that allows to give visas for 50000 applicants within the time allowed, so that all would qualify, the chances would be equal, and no fraud would be among those who got their visas. So they disqualify entries with reasonable fraud risk.
