Mistake in approval

Hi All,

My company had file for H-4 for my spouse and son in October 1 2004. I got recent approval but in the approval notice it says only approval of my wife not for son. And she was approved for F-2 instead of H-4. She was already on F-2 and as i am on H-1 we requested for H-4. Now i am confused. My company had file again I-539. Can any body tell that if there is not on our part of mistake when we filed first time fro F-2 to H-4. What should be the procedure to follow up with USCIS?

Check whether your attorney made any wrong tick on check boxes. If it is INS is mistake, you can request them to amend the approval to H4.

Thanks for your reply . I dont know if its mistake from my attoreny, my company is not giving me correct information. Please tell me is its mistake from our attoreny what could be consquences or what can my company can do to rectify?

If it is attorney mistake (it is very hard to find out from the attorney), then you have to file another (new) petition with good attorney to change F2 to H4.

Mistake in H-4 approval

Hi great guru,

As you say if it's mistake of USCIS, then how can we do amend the approval to H4? Is there any special forms we have to filled it out ?
