Military Member needs some advice.

I am in the U.S. Navy posted at the U.S. embassy In Brussels, Belgium.
My wife came over to the U.S. on a K1 visa in Oct 2001. We got married in Dec 01. We lived in Maryland until Nov of 04. Then my wife and I were posted on government orders to Belgium.

We got as far as the temp resident status. We were suppose to change status to permanent in Sept 05. I contacted Frankfurt, Germany INS director a couple of months prior to Sept 05. He stated we could not do anything until we got back to the U.S. A couple of months ago I contacted Frankfurt again. They looked up my wife's case and found that it has been abandon, and recommended that we should file form I-751 condition status removal along with all the paper work proving that I am on official government orders and that they would put my case on a government hold. Also a month prior to my wife and I leaving Europe for the U.S. we have to get a travel letter. I am a little confused and don't know what to do.


My wife has a social security card,Maryland drivers lic,military ID card.
Her purse was stolen and in it had her Temp resident card in the summer of 04 so we paid for a new one but never received it due to moving to Belgium in Nov 04.

She worked the whole time we were in MD.
She is currently working here at the U.S. Embassy in Belgium She also has been paying U.S. Federal and State taxes the whole time in MD and here in Belgium at the U.S. Embassy.

The embassy were we both work can't help us, they point us towards the Consulate in Frankfurt.

I have all receipts and paper work from INS and tax forms as proof.

Does any one have any insight on my issue, I am looking for any advice before I get a lawyer involved.

According to I-751 instructions, she should have filed the form 90 days prior to her 2 year GC expiry even if living abroad. She should have used the service center that has jurisdiction over her last US address. All she had to do was attach a copy of the government orders assigning you and her abroad.

At that time we were unaware of that, this is why we contacted INS Frankfurt.
Now we are almost 2 years after the fact and are going back to US around Jan of 08. Any ideas as to what should be our next step?
 
Well I guess I will go ahead and send in the I-751 form. But being over seas I guess I don't have to send in 70 dollars for BIOmetrics. Because I have to send in pictures and I'm out of the country so we couldn't go to any appt anyway. Funny thing is My wife and I have done the biometrics twice already!! How many times are we going to have to have fingerprints and pictures taken. And of course pay the fee. Last two times it was $50 for each of us, now $70! We even did the electronic machine in Baltimore! My last calculation of my reciepts was around $2000. Wish me luck! I will post my results when I get my notice back.
No one can ever say that if you work for the government you get special attention, at least not to me! :(
 
Mailed in I-751 form on July 3rd as directed by Frankfurt consulate. It's now the 24th of July and no news yet!

why in the world would you, the USC, need to do biometrics??????

FPs expire every twelve months while your petition is pending.

Hi,

I am not so familiar with the Navy. But for the Army, they have Army JAG Corps which, I think, help service members when it comes to legal stuff whether in US or abroad. Im not sure if Navy does the same thing. You might want to try, or seek for an advice to a JAG office on your post. Who knows they can help you out(before actually hiring a lawyer who charge you big time!)
