hi,
when you sent foipa request,did you mention it's for
I485?
I used a template which did not state it's for my I485 application,
will this pose any problem?

Looks like u and I are in the same boat as far as "rejected by the FBI computer system" goes. Mine was submitted in June 2003, rejected by the system. I raised an inquiry with uscis in dec 2004, then they sent another submission to fbi, which is pending.

How did u folks find out that your name-check was "rejected by the FBI computer system" ? USCIS is not telling me anything abt my case and I have not received any reply to my e-mail to FBI dated 12/16/04. What should I do ?I have opened up 2 inquiries with USCIS till date with the latter one resulting in 'shortage of manpower, security clearance shit'...

I got that message as a reply to the fbi email. So, one of these days, you should get a reply to ur email, which should give you an idea.

Did you guys notice that the following lines "in December 2002 to early 2003, the USCIS submitted an additional 2.7 million name checks for processing to the FBI. Although 99.7% of these cases have been finalized, our efforts to complete the remaining requests continue. This has delayed processing of other requests" didn't show up in the most recent FBI replies? Maybe they have cleared up this backlog?
 
yea, see, mine reads "....that a
request from the U.S. Citizenship and Immigration Services (USCIS) was received
on June 3, 2003. This submission contained an error and was not accepted by our
automated system. However, our records also show another submission received on
December 29, 2004, and it is currently in a pending status...."

Keep wondering, from jun 2003 to dec 2004, what the heck was goin on :mad:

This has become like a "courat kacheri" deal.
 
don't think they have cleared Name Check backlog. Mine is in Sep,03 and still pending.
 
Don't you think they keep us waiting is only going to make security worse? Since we are not cleared, we are terror suspect and they keep us in this country without legitimate status?

my security check is pending.

I would not say that name check is pending as someone is terror suspect.
To me it reminds me of Indian Govt. dealings :p

confused about the response letter of FOIPA from FBI

Finally, after almost 40 days waiting, I received FOIPA response letter from FBI for my wife. I heard that it is good if the letter indicate No records. But I am confused regarding other appeal instruction. If no records is good, why we need to appeal??? Should we appeal? Is this a normal, standard response letter from FBI? Thanks for help!

The response letter is like:

This is in response to your Freedom of Information-Privacy Acts (FOIPA) request noted above.

A search of the automated indices to our central records system files located no records at FBI Headquarters responsive to your FOIPA request.

Although no records responsive to your FOIPA request were located in our automated indices, we are required to inform you that you are entitled to file an administrative appeal if you so desire. Appeals should be directed in writing to the Co-Director, Office of Information and Privacy, U.S. Department of Justive, Suite 570, Flag Building, Washington, D.C. 20530, within 60 days fro mthe date of this letter. The envelope and the letter should be clearly marked " Information Appeal." Please cited the FOIPA request number assigned to your requst so that it may easily be indentified.
 
Reachsky, You don't need to appeal. It is all std. lingo.

Next you should draft a name check expedite request with FOIPA attachment and then count on your luck.
