A review of the FBI's Name Check Program database revealed that a request from the United States Citizenship and Immigration Services for you was received on July XX, 2003, and is currently in a pending status. Due to increased national security concerns, in December 2002 to early 2003, the USCIS submitted an additional 2.7 million name checks for processing to the FBI. Although 99.7% of these cases have been finalized, our efforts to complete the remaining requests continue. This has delayed processing of other requests. :o

July 2003 !! What should I do now ? Friends help this old timer. I mailed them on Dec 05 2004. Now I know why I never got approved last year :mad:

Can you request your congressman to help you in this regards? I have not read anyone trying it before, but it may just work...

Congressman or Senator are not the right resource especially for Security Reasons. I strongly suggest you to first send a FOIPA request to Mr. Hardy's office and in less than a month you should get response and if you get "no records" then you should personally write a letter to Mr. Hardy to expedite your name check request and also attach the FOIPA response, any USCIS response for your inquiry which says that your case is pending because of security check pending and I am sure he will be forced to work on your case.

But, if you get your name as hit in Main Search or Reference search then its totally depends on the mercy of FBI Analyst. Good Luck!

Thanks need help. Even google returns ony one exact name match. I am searching this forum to get FOPIA info.

I am surprised now on myself. I should have done this last year or so.


USCIS says that VISA is not available and now I know what they gonna say when VISA is current for EB3/IND

I think I am in the same state as you are. Although I have not received a response for my FBI email (sent Jan 2005).
I have sent a letter to Hardy.
Hoping to hear from him.
 
No. FOIPA will only give results for the Main Search and NNCP program will give results for main as well as reference hits. You can see one of my post for details about it.

what manner of response was this?
did they respond to your email to FBI or is this from INS?

i myself have thought of filing a FOIPA...however a tip for you...i spoke to INS recently and the lady says that you can tell that your sec check is cleared when LUD changes suddenly..she says that the results are downloaded automatically to the user system...

could help understand why LUD keeps changing out of the blues ....

also if u decide to file your FOIPA are u planning to use the format posted by rahul kumar earlier?

This response I got from FBI as I mailed them back in Dec. ( NNCP address ) The response looks standard so I am not panic. I just need to follow up now and let's see how it goes.

I see one LUD today but that's because of an enquiry I opened few days back ( VISA # not available response ).

I have updated my lawyer and am waiting for a response. FOIPA or Congressman :confused: I think I should draft a FOIPA now.

I don't agree at all that LUD change indicates a cleared name check . I am sure ( am I ? ) that officer picked up my file on 11/8 and put it back ( as name check was not clear ), when I relate my case with LUD dates. I know few other folks as well who share same fate.

My and my spouse's namechecks are pending since oct 2003.
I received response for my FOIPA and sent a letter to D.Hardy asking to expedite namechecks. Now, waiting...
If anyone is interested, sample of this letter is in one of my earlier posts.
 
FOIPA letter did not use template

I have sent a letter to Mr. Hardy on 4/7/05 requesting requesting status of name check. I did not follow any template. Did not do a standard FOIPA.
Will my request be ignored. Should I redo it (first using FOIPA template and then follow up with letter ) ? Please advise guys.

MD_Rockville: I am with Exact same dates with the same reply from FBI. Contacted Congressman also but same answer from them. Just resent the request to FBI, this time by regular mail

We recently did a FOIPA request and received a response ‘no record’ for both of us. Copies of the response are attached.

Mailed FOIPA ( USPS certified mail ) .. waiting for response and then I'll take the next step..

Well PD is still at Jun 02.. long way 2 go :confused:

My AP and EAD got approved in 2 weeks ( filled on April 11 )

Wow, I am wondering why they are holding my USCIS name check since 2003 July :o

Name check letter with FOIPA attachment is my next move ..

how do you know that your name check was initiated in july 03?

it is quiet possible that it may not have been initiated yet..these idiots are clueless at the call center/Vermont and dont always tell the truth.
