It's Not So Bad!

Why Does It Suck?
Row Employment Based Moved 1 Year!!!!!!
And Also For Some Other Countries.
I See Improvements!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

OMG..., I cannot believe EB3 world jumped a whole year. AMAZING...

This is great news for me. I'm finally current.

I'm sure a lot of lawyers are getting phone calls this morning.

EB3 ROW moved by ONE YEAR???!!! It's not a mistake?

I hope it's for real, because it makes my Priority Date current!!!

I thought the EB3 RoW date was an error too, until I read....

Therefore, in an effort to maximize number use under the annual numerical limit, the Worldwide and Philippines Employment Third preference cut-off dates have been advanced by one year.

I'm current now! Hopefully I'm NOT stuck in name check hell right now.

Why there's a name check? What is that for? Is this the FBI name check?

Name check is a part of the security clearance process you need to go through to get your I-485 approved. A quick check is done to see if your name matches any known "security risks". If it does (and it happens a lot), someone needs to manually go through the records to confirm you aren't that person. It can takes YEARS. I believe it is the same thing as the FBI name check.

I'm hoping that since my I-485 has been pending for 1 year and 11 months that my name check has already been cleared.

Ok thanks. Is that all country or for specific country? or Is that per Category?

My friend already got his Green Card within 3 months, he's EB2. I never heard from him about Name Check.

Just for info.

Great News for EB-3 WorldWide But Confused - Please HELP

1- Does USCIS forward I-485 application (once approved) to National Visa Center? once priority date becomes current? please elaborate on this. Called NVC support and provided SRC# for my case but no information is available b/c application has not been received? should I call USCIS and ask about delay if any?

2- My priority date is now current, now what? how long before I get any notification? or what's the first notification I will get about my case?

PD: Nov 15, 2002 (EB3 worldwide)
I-140 AD: Jan 2005. I-485 RD: Dec 2004 LU: August 2005
FP: August 2005
Last EAD RD: Oct 2006 AD: Dec 2006

Thanks so much.

Most people's name check gets done within a few weeks, so they don't even know about it. But there is an unfortunate percentage (10%? 20%? 30%? I'm not sure) of people who get stuck for several months or even years.

First off, your priority date is NOT current right now. It won't be until May 1st.

I don't believe that any I-485s are forwarded to the NVC. Once your I-485 has been deemed approvable, a call is made to the NVC to see if a visa is available. If it is, a visa number is provided and the case is approved.

If you do a search, there was a document posted on this website that goes into great detail about the approval/visa assignment process.

The best way to see if your case is being worked on is through the uscis.gov case status service. Create an account and it will show the last date your application has been worked on.

Don't even bother calling the USCIS until your priority date has been current for at least a month.

Thanks mdh3000

Thanks mdh3000, your reply was VERY helpful. I will wait til June 1 if no update from USCIS by then. No doubt this is the fastest and most effective way to answer questions about immigration. I'll check link you suggested as well.

Later.

Thank you for your information. Appreciate it.

When to file I-485?

My PD is March 2005. My LC and I-140 have been approved (EB3). When can I file I-485? Do I have to wait for the Priority date to become current before the I-485 can be filed, or can I file it in advance while waiting for PD to become current?

Thanks for your replies!

You can only file 485 when your PD becomes current. Refer to the latest visa bulletin to check the cutoff dates for your category.
