if you do so shortly after entering the USA, then you are committing fraud. by misrepresenting yourself entering as a visitor, when you planned to immigrate and then yes, they could deny your petition. (this is assuming you are talking about immigration to the USA).

People can change their mind and decide to stay permanently after entering the US. Here the OP already has an intent to settle permanently. two very different scenarios.
