*passport with i-94 lost (no copies of anything)

have:

*drivers licence

*attendance letter from college

questions:

*what kind of scenarios could possibly unfold in dialogue with dhs?
*what avenues should be explored to prove that i entered the country legally?

Hmm... this is a difficult one!
As far as your overstay goes, it should automatically be forgiven by USCIS as you are now married to a US citizen.
I would think you could contact your nearest embassy about your lost passport, but I don't know how they'd respond considering your current status.
I think the best thing to do would be to consult a lawyer before you do anything.

I know of a few peple who have been able to request a copy of the I-94 from INS. I am nt sure about how lng the process takes. Speak with your lawyer if you have one or research on www.uscis.gov

How long should I be married to apply? Is there a limitation on how soon after marriage I can apply?
Is I-130 required for I-485, or Can I use the H1-B approval instead for I-485?
If required, Can I apply for I-485 (Adjustment of Status) along with I-130 ?

* What is required from my spouse along with I-864 Affidavit of support?

- financially, as in how much money does she need to have in the bank.
- salary, as in how much money does she need to make from her job.
- Can her dad be a co-sponsor? What are the requirments for that?
- Can someone who is not her blood relative be a co-sponsor?

* What happens to my work Authorization?
Do I need to apply for a I-765 or will my H1-B suffice?
If I file for I-765 and it is approved, can I work for any employer?

* Do I need to supply proof that this marriage is not based on Green Card application? Just FYI - its not :) We have known each other for more than 3 years now, Will that count ?

* How does the USCIS view a marriage as complete, final and bonafide ?
I understand there can be no definitive answer, but whats the general view?

Thanks AmiShah. I had done some research at uscis.gov and gone through many web forums for H1B->FB green card process. I couldnt find a nice little summary that answers my query specifically.

You can show proofs such as a joint bank account, lease with both your names, as in our case copies of airline tickets as we were dating long distance, dating pictures. You can take as many things as you want. Visit www.uscis.gov for other questions related to the financial requirements etc. If you click on the forms and fees section, the actual forms have instructions that are definately helpful. The insructions are clear and simple to follow.

Yes

No. You can file the day you get your marriage certificate.
Is I-130 required for I-485, or Can I use the H1-B approval instead for I-485?
This process is different from employment based GC. You need I-130 to prove a relationship with the USC when you file I-485.
If required, Can I apply for I-485 (Adjustment of Status) along with I-130 ?
Yes. As the spouse of a USC, you are eligible to file the I-485 concurrently with the I-130.

If she earns more than the minumim income requirements against the poverty guidelines, it doesnt matter how much money you need to show as saved in the bank.

Since you are on H1 and i assume that you earn more than the minumum requirements, you can use your income if your USC spouse does not meet requirements. If not, then you can always get a joint sponsor.

max1, you have to have a proof of entering the US with inspection, hence I-94, or its replacement and other proof is a must.

actually i have filed!
i-102 and i-130

thay have searched and come up with nothing
thay asked for more evidence to support legal entry
all i have is

*drivers licence
*ss #
*attendance letter from college

these are used to make the case that i had entered with visa
circumstantial at best but that is ALL i have going for me

for instance....
school enrolled me. i was then eligible for student visa
ss card was only given because i produced valid documentation..ie:valid visa and passport
drivers licence would have been issued with passport as id

currently i am asking ss office where i applied if they have records of my application/photocopy of passport etc

so...this is what i want to know..

are there other avenues one can explore to show as best as possible that i entered legally?

Do you have the copy of your I-20 you used when entered the country? The I-20 has a stamp on it showing the date and time and POE. You may be able to get a copy of that from the school you attended when you first came here and that may prove your legal entry and inspection.

You mean you filed I-102 and didn't get a replacement for your I-94?

they could not find any records of entry (86 and 88)
they indicated that more info was need to embark on a more "thorough search"

Please Help ! Lost passport questions

My current Indian passport ( with active multiple entry US H1-B1 work visa stamp valid till August 2007, active UK multiple entry visa, and Schengen visa stamp) stapled to the old passport, was lost in mail by British Consulate -NY and FedEx.

I was issued this passport in April 2005 in India. I am going to apply for a duplicate Indian passport at the Indian consulate. Does anyone has any information about how much time it normally takes? Do they atleast issue a temporary passport for emergencies?

I am aware that I can not get new visa stamp in the usa and will have to goto India for the new stamp.

How long does it take to get the replacement I94 ( stapled to the lost passport)

I am working for the current company for last 4.5 years and was looking for another job so that the new company can file for my H1 and green card. I have got a new job offer from another company. Will be able to transfer or change jobs in between even though I dont have my passport. I have the photocopies of the passport, all visa stamps, I-94 photocopy original lost with passport) and original I797 document from INS for the current company.

Please help me ! Any feedback is highly appreciated (specially regarding process, time frames and job change.)
