I have Green Card since May 2008 and I got married about a month ago. What should I do? My spouse is outside of USA, in my hometown! Is there anyway that expedite the procedure? I have checked 'processing date' on uscis.gov website says between 5 to 35 months depends where you filed!

Any commend will help, please tell more details as much you can. Thanks.

Actually, it takes longer than that. It will be ~5 years before a visa becomes available for your spouse assuming you stay a PR; you will be a citizen before then and then file for her. That'll take around 6 months.

you mean shr is gona be away for 5 years?!

actually that could not be true! with my previous experience it took 3 years! my x-wife applied for me when she was green card holder in november 2005 and i got NVC visa in august 2008! but that time we had already divorced i did not need her benefit and i got my own green card may 2008!

Hence i need usefull info who knows shorter way! not saying like 5-6 years!!!!

she got just few months ago!!! december 2009!!! and as i mentioned above we got divorced 2006! when NVC sent me paper 2008 august I got my LPR may 2008! so i just did not even care that NVC visa paper even still the paper at my home!

So please anyone who has better knowledge will help, thanks

whatever you telling me is depends on that website? I am talking about my experience!!!! since i got USA whoever told me something about those immigration stuff got WRONG even attorneys!!! even when i put my lin number it still says i m on progress for green card!!! but i have mine since 2008! people having different experience, they are having different dates on different legal paper even their own!

that is why i am askin usefull and shorter way!!

even i have checked the NVC paper right now it says june 3rd 2008 and says go apply for visa any nvc office near by you!

my ex-wife got citizenship december 2009! and we got divorced 2006

You have absolutely no clue what you are talking about. Here's the visa bulletin for March 2010: http://www.travel.state.gov/visa/frvi/bulletin/bulletin_4659.html

The world-wide FB2A date is April 1st, 2006. That means that the only way one can get a GC as the spouse of a US citizen is if the I-130 was filed on or before April 1st, 2006. So four years, not five. It doesn't matter whether USCIS took 3 days or 3 years to approve the I-130. Once the I-130 is approved, one needs to wait until the priority date is current, since the category is oversubscribed.

Since you got your green card via marriage to an LPR or USC, you have to wait 5 years after your green card approval before you can file I-130 for your new spouse. So that would be May 2013.

Were you already married to your ex-wife before her green card was approved? Who sponsored your ex-wife's green card? The timelines you are listing make me think your green card was a derivative one tied your wife's primary application via employment or another relative.

you see that!?!!! even with your first reply you were talking about 5 YEARS AND MOREEEE!!!!! even that websites telling april 2006 which means not even 4 years!!!!! that is the first thing i m having yours attention that do not dicourage people giving negative and imcorrect ANWSER!!!! Because all those processing are too crucial and emotional for people!!!!!

And i am telling again that try to help people out to tell people 'BETTER WAY' than even 'ordinary processing'

That is not correct EITHER!!! you can apply for USC 90 days before 5 years done!!!! which means i will be eligible on january 2013!!!!!!

I am pretty sure on that i will find shorter way and i will share with this forum members!!!!!

I am not talking about when you can apply to become a USC, I am talking about the 5-year restriction on filing I-130 for a new spouse. That restriction applies whether you become a USC or not. Read the I-130 instructions.

It is almost six years for Mexicans. Don't forget that those dates are not guaranteed to remain constant; depending on how many people have applied in the past few years the wait may decrease, or increase.

I stand by my answers. Despite a minor inaccuracy in the FB2A wait, they remain far more accurate than what you have been coming up with with.

And i am telling again that try to help people out to tell people 'BETTER WAY' than even 'ordinary processing'

There is no "better way".
