Marriage & Witholding of Removal

Hello,

My wife and I were granted witholding of removal after our application for political asylum was denied. We married in 2003 and were granted witholding of removal in August 2005 by an immigration judge. A friend of the family has some personal issues with us and has denounced us with BCIS saying that our marriage is fraudulent and that I married my wife to obtain political assylum/witholding of removal through her (she had a kidnapping attempt in Colombia as a result of being part of a political party).

This person's claim has no legal basis, however my wife and I fear scrutiny by BCIS; we fear that BCIS will come to our home to ask questions, to search our home to find evidence that we are in fact married, etc. Besides the time wasted to defend ourselves, we will have to probably retain our attorney to defend us.

Are our fears justified? What is BCIS's normal procedure in cases like this in which someone calls them and tells them that a marriage is fraudulent? Will they come to our home to question us?

Thank you!!!

One--they generally ignore those reports from disgrunted "friends" unless there is real evidence behind the reports.

Second--if the marriage is real (you are the best judge of this) then there is no need to worry about anything.

Don't worry. They got those calls ou letters very consistently.

Your withholding of Removal was final and case closed.

Only the Attorney General can revoke it. We understand Attorney General could mean USCIS. Since you are not a National Threat, you are neither a Terrorist, You are not conflicting with any of the USA National interest.

You will be fine.
Most likely nothing is going to hapen to you, No outcome to that.

Best Luck.

You don't need to worry. But what you should do is try to change your status ASAP as witholding of removal you cannot apply for a green card and can never become a citizen, you cannot travel outside the US plus many other issues.

You should try to change your status if you ever want to become a citizen of this country or get a green card.

Thanks

Ed
