hi i have a question about marriage with a international student whos with a F-1 visa. i would like to know if its better for me to marry her in USA or in her country (S.Korea) and what are the diffrence between 2 country . because i heard green card will be out faster in S.Korea
Also what do i need and how long will it take for her to get her greencard ? I also heard that i need minimum of 30k salary a year for her to get a greencard is this true ?
Finally if i marry her will she be paying international price or US resident price in college ? or what do i need to do stop her from paying internationl student price in college ? because shes paying 10 times more of what im paying in college

I won't know about south Korea but in the USA you get a marriage cert copy immediately (in 10 days). Marry her, preferably, in the USA ( at least officially).

Also what do i
need and how long will it take for her to get her greencard ?
Assuming that you are a US citizen, it shud take anywhere from 4 months to infinity. Do you livein Texas..you can go thru DORA...it's faster

I also heard that i need minimum of 30k salary a year for her to get a greencard is this true ?
The 2007 poverty guidelines were recently posted. I kind of skimmed thru it...for a family of 8, you need 43k or so salary, I think you are ok ( the sponsor). She (the beneficiary) does not have to have a salary. For a family of 2, it is well below 30k...no worry.

Yes, international fees, she's not a resident for immigration purposes but she can be counted as a US resident for taxation purposes. That way you can get upto 4k /yr deduction for her education or even get tax credit (hope or lifetime learning). But you have to inform the IRS in advance about that. Those are seperate topics....Check out publication 519 ( iirc) , it has info for it. You can file taxes jointly and avail of that deduction every year

or what do i need to do stop her from paying internationl student price in college ?
You need to stop her education...JK !!!
You cannot do anything..sorry. Internation students have to shell out the dough for every educational expense here....no shortcuts, sorry

because shes paying 10 times more of what im paying in college

Oh ya..that's life as a F1 student...sadly

Is your current salary above 17,113 US dollars? If yes, you are ok...the 125% column shows that your salary shud be greater than that for a family of 2. !!!

No , not in CA.

I AM NOT saying that, I am assuming that she will still be on f1 for a while b4 you file and b4 she gets GC status. You haven;'t even married her yet, buddy. I have no idea what happens while she is "adjusting status", if her school can accept ehr as a resident or not...pls check with her school
there gotta be some way for her to pay
US resident price in college .
there might be, ask the school

my philosophical advice ?: money comes and goes..don't make that your highest concern for now, she's in the USA, isn't that a great thing for you ?

sorry i have many quesitons but ill make this be the last one.
1.so if i dont make over 17k year she wont be able to get her Green Card?
2.so if she does get her Green Card she wont have to pay international rate in college?
3.is there anyone i can call such as a official person that works in this field?
perhaps a marriage lawyer of some sort? maybe a phone number ?

THANKS for your HELP

2.so if she does get her Green Card she wont have to pay international rate in college?
in most states she will pay in-state tuition after a year of being a US resident. Some states allow her to pay in-state tuition while she is waiting for her GC (after applying for AOS). You need to find out at her college (Financial aid office or the registrar).

1.so if i dont make over 17k year she wont be able to get her Green Card?
if there are only two of you, you'll be fine. You need to make $16,500 a year.

If it is just the 2 of you, your income is enough. Look at the poverty guideline for a family of 2 people. It says $16,500. You qualify.

You can find out from her school what is required. She should have a green card (if everything is in order) between 4 months - 1 year. So if you all can survive that long with the international rates then things will change for the better. Hang in there.

Hi:

Even if their income is sufficient for immigration purposes, I wonder if it would really be sufficient to support the two of them. $17K a year is not a lot. I am not saying it is impossible, because lots of college students manage to scrape by, but they should think about it carefully. Unless they live in a small town or are willing to live in a really run-down area, rent and bills will almost certainly chew up the entire income, never mind the high gas prices and other miscellaneous expenses.

Once again, it is not impossible, but they need to have a plan. One can sometimes focus so much on immigration that the other considerations are left behind.

yes, but once they file for AOS, the girl will be able to work and that additional income is going to bring their household income up.

Some people live on a lot less than $17,000 (family of 1-3), and they are US citizens or GC holders.

Hi:

Oh yes, I agree ---- I just meant they should be aware of that and take that into account. Where I live, it would be hard to get along with that kind of income. Of course people do it ---- I actually admire them. It must take either lots of tolerance or lots of creativity!

it truly does. One family I knew (US citizens) had three children and they lived on a very small income of a graduate student. Wife was also studying. At some point they had to ship wife/children to in-laws, and the husband was sleeping on a kot in the department, taking showers in the university gym. They had to do it for about a semester till he graduated and got a job as a professor at a university.
