Fairness....forget about it...
GC holder has 4 years to go to get US citizen......So when US visitir visa is expired spouse have to go back to his home country & wait for 4-6 years... Thats not fair........... Isnt there any way that visitor in US married to GC holder extend his visa or legally stay in US till his case is decided.....
newone...worldclass,
Fairness should never be part of your vocabulary when it comes to the immigration system of this country, nor for any country. That's the first rule for you to survive immigration torture 101....
You married someone who has a greencard, you choice and be happy with it. The question becomes, did you marry her for the love and all the good things we decided to get married for, or for the fair immigration system which could have gotten you a greencard

You ought to enjoy your wife every night till you go back to your home country, and wait till 2010 or so, to complete the immigration process..
The fun part for you, you won't be issued a 2 yr greencard, but a 10 yr card since you would be married well over 2 years. More importantly, USCIS would not have any motivation to deny your greencard application, after all... you have been married longer and stayed out of the country for 3-4 years.
Forget about fairness... focus on what is lawful... your life will be longer and interesting....

lastly, you never want to become a world class vagrant in the United States... As such, be thoughtful in making your decisions...
