She has her bachelor already and she does intend to study nursing in a college but i am just concern about her legality here while waiting for her I130. I will consult with an immigration lawyer to give a good case scenario.

If she has a bachlor, she can try to go the H1B route as well. But the problem is H1B quota for bachlor holders is not big, so you might need to wait longer than you want.

If I were you, I will take the F-1 and then H1B and then marriage route. I think this is 100% legal.

But please let us know what your lawyer says.
