I am a US Citizen who is going to india to marry my fiance who is in india. She has been to US before on her student visa and finished her masters here. But that student visa is no longer valid as her university had problems with the immigrations. Anyways, do I start the process with filling out the I130 form? How long does it usually take for the I130 approval notice. SOmeone who has recently filled out I130 paperwork, can you let me know? Has anyone visa not been approved? Also, any tips on what i should avoid so it doesnt take longer than it needs to?

Thank you

If you have your hearts set on marrying in India, then after you marry, you file the I-130 with USCIS in the U.S. You have to actually reside abroad for a certain period of time in order to file the I-130 abroad. This could take anywhere from 6 months to a bit over a year AFTER you marry.

If, on the other hand, you would rather file an I-129F and bring her to the U.S. as a fiancee to get married in the U.S. (within 90 days of entry) then you could be living together in the U.S. sooner. This could take 3 to 6 months (without unforeseen problems or issues) for her to enter the U.S. as a fiance after you file the I-129F.

Explore your options and see what's right for your situation right now.

Thank you for the reply BigJoe5.

I will be going for two weeks, get married in gujurat and then come back here and apply for I-130.

While I am in india do i need to turn in any paperwork over there which can help us.

You have to contact with some immigration consultant otherwise if you have the US nationality then appeal in the court for the hurry work.
