I am not a lawyer. My opinion is mainly based on the quote from 9 FAM as of 10/23/2008 that you read.
Beside that, before this comment appeared in 9 FAM on 10/23/2008, not surprisingly, I had exactly the same opinion on the matter. I guess it was expressed somewhere here at this forum before 10/23/2008. At that moment it was based solely on common sense. However, I was a little bit surprised what my thoughts appeared in 9 FAM as a valid instruction.
