Lpr I-130 Filed For Spouse/ Can File 485????

hI EVERYONE,

here is m situation.

I am a lawful permanent resident of US. I filed for my wife's immigration petition I-130 in August 2002 after I got married to her in March 2002. I want to find out the following.

a) Can I file for 485 adjustment of status without having an approval. Some web sites say you can file it with 485 so that you already are part of the line for immigration number. Please note I am a LPR not a US citizen.

b) My wife is here with me in the US. She holds an asylee status and has not gotten out of status. Will this impact her work situation if she files an adjustment of status through me.

c) What happens if she wants to travel outside the US? If she is able to file i-485 based on my pending petition(I-130) , can she obtain an advance parole?

Please advise urgently.

If your wife's I-130 petition is based upon marriage to an LPR, she CANNOT file an I-485 until her priority date becomes current. Once you become a US citizen, she can file the adjustment immediately after you are sworn in.
