Lottery vs. F1

Dear LucyMO and Baba Aladura,

How are you? First, I would like to thank you guys for your support about my comments in Lottery vs. F1 subject. I still have concerns about this issue which are about the possibilities of these: Can they prevent me to get in the USA again while I'm home for a vacation? The reason is because since the last time I came from home, the INS asked questions if I had worked or applied for a green card. Unfortunately, I told them I have applied for a lottery program but I canceled the application. The truth is I didn't cancel yet the application for the lottery, so they noted it down every word I have been said on to their computer. I called the lottery organization which is USAFIS and I asked for the cancellation progress. One of their specialist talked to me and discus about this issue. He said you are completely fine since you just renewed you F1-Visa and got in the USA. After that, I decided to have the application so I might win the lottery within the next four years. It is really difficult to make a decision about issues like what I have but I wish people like you can direct me the right path.

Let me clear something. You don't need USAFIS to submit your visa lottery entry. Just go to the Dept of State website once they start receiving application in October and fill in the entry yourself. It is free and quite simple.

Once again, you can go in and out of the US so long as you have a valid visa [in your case F-1]; you don't have any problem.
Again, applying for the lottery is NOT appying for a green card.
When you apply for greencard you have to fill specific forms [I-140, I-130, ds-230, etc] Until you fill these forms and submit them, YOU HAVE NOT applied for a green card. If you are asked again whether you applied for green card, the answer is NO, NO, NO.
The lottery is only a "wish" that you will get a green card, it is not the same thing as applying for a green card. The US govt does not penalize you for having the "wish'. Only when you send in the forms [I-140, I-130, ds-230].
If you are asked about your last answer at the INS post, just let them know that you misunderstood the question and the process.

I don't know about the other forms but I-140 dosen't change ur status until u file I-485. Anyway, i was going to file my I-140 for EB3 next wk but i probably won't. I'll rather save my money and file I-485(dv lottery) whenever my number becomes current next yr. Maybe this yr since the numbers kinda started higher than previous yrs.

Baba Aladura, I had a phone call in this concern with the US Embassy in Frankfurt, Germany.
Their answer
Dear Mr. and Mrs. X,

The processing for DV-2008 start with the beginning of the new fiscal
year, (Oct. 2007) and will continue till September 2008. You can travel
visa waiver for your business in September of 2007.

From October, 1st the Department of Homeland Security has your case in the system and know about your intent to immigrate to the US and maybe not let you in.
 
I'm confused. What should I do. Should I stay until I get done from college? This will take about three or four years. I think I made a big mistake about this on myself. Everyone, Thank you very much for answering questions and I owe you this for the next time "hopefully :)".

I will think of going or staying until get finished.

Kathleen Riley: There is no reason that you cannot apply for the Green Card Lottery while at the same time studying in the US. The only way this would be a problem would be if the consular officer thinks that you might be applying for a student visa only because you are planning to use it to immigrate to the US. It will be up to you to convince the officer that you are a serious student and that your major plan is to return to Saudi Arabia when you have finished your studies. If you are lucky and win the lottery, you will need to go through a different procedure before you can actually immigrate.

From my point the situation is compareable, you can run into problems, but nobdy will give you a mandatory answer. Thats a big problem and for that reason we changed our plans and travel the last time in September to the US and next after the interview in the US embassy.
