Hi!
I am a new member of this forum and have query.
My ( and my dependents H-4) H1B visa stamping expired on JAN 14 '2003 ( already 6 months ).
I came to US during Jun 2000 and my family during Aug 2000.
I changed employer during Jun - 2001 and new H1B and H4 have been obtained. The new H1 expires on JUL ' 2004.
I need to get visa revalidation.
We all have the Original I-94 ( the one we got when we came to US during 2000) stapled in the passport. We did not visit India or any other country after we cam to US.
My dependents have the NEW I-94.
Unfortunatlely my NEW I-94 is missing.
My employer has the my original I-797 ( without the I-94).
What shall I do ?
Do I need the NEW I-94 or the Original I-94 for rvalidation ?
I am changing employer again and H1B transfer is under progress.
I do not have any intentions travelling to India for another year.
I need to revalidate my visa before JAN - 2004
Please give your valuable experience and advise.
Thanks,
Venkatesh

----- Do you mean when you changed employer during Jun – 2001, when your new employer filed H1 transfer you did not get new_194 attached with your H1 approval notice? And your spouse got I-94 extended and attached with H4 approval from Legacy INS or BCIS?
My employer has my original I-797 (without the I-94).
---- Check this approval notice, it may have I-94 attached lower part right side?
What shall I do ?
---- Check the approval notice, and then let us know
Do I need the NEW I-94 or the Original I-94 for revalidation?
------ You need both the I-94 the white one that you got when you came to US and got at POE and the valid I-94 that you got with H1 transfer and extended till the validity of H1 approval notice of new employer
I am changing employer again and H1B transfer is under progress.
----- If you are changing employer again did you submit the valid I-94 with the h1 papers? Because valid I-94 is needed to extend/transfer H1
I am confused because at one point you say that you don’t have valid I-94 and at the same time you post that you filed for H1 transfer. Do you mean your new employer filed NEW H1 with out valid I-94?

do you have any I-94 that is valid?

Thnaks for reply.

**** My Employer did send me the NEW I-94 which I LOST !
My employer has my original I-797 (without the NEW I-94 at the bottom).

---- Check this approval notice, it may have I-94 attached lower part right side?
****He does not have NEW I-94 stub as he had sent it to me. He has the I-797 without the I-94 stub.

****I have only one I-94( the one when I entered US.

***I am not sure if my lawyer looked into the validity of I-94.
I am sorry, He will be applying for transfer soon.

By the way, for H1 transfer, is valid I-94 must ? Is I-797 ( approval notice which also indicates expiry date, not sufficient ?

I was going through the US Dept of State web site (http://travel.state.gov/hlop.html#2) and the following is the info related to I-94 requirement :

"The original or a certified copy of Form I-94, Arrival-Departure Record annotated by the Department of Homeland Security (formerly Immigration and Naturalization Service) inspector from your most recent admission to the U.S. Please staple the I-94 to a page in your current passport"

Please advise.

One more update.

From web site :
http://www.us-immigration-attorney.com/revalidatingh1b.htm

(2) The original or certified copy of Form I-94 annotated by the Immigration and Naturalization Service (INS) inspector when s/he was last admitted to the U.S. The original I-94 should be stapled in your passport. If the Form I-94 has expired, you should submit a valid Form I-797 Notice of Approval from the INS for each visa applicant.

If the Form I-94 has expired, you should submit a valid Form I-797 Notice of Approval from the INS for each visa applicant.

What is this "valid Form I-797 Notice of Approval from the INS " ?
Thanks

H1B approval notice is I797.
All they(revalidation people) are interested is in your last departure and arrival record.
