Lost EAD: renew or apply a new one?

Hi,

My wife lost her EAD which will expire by this June. Unfortunately we don't even have a photocopy for the lost card. So we are not sure if we can do a renew since renew will require a copy of the current card which we don't have. So here are my questions and I appreciate if anyone can provide answers.

1. Can she applys a renew for her EAD without a photocopy of the current one?

2. Can she just apply a 'brand new' one which won't require the photocopy of the current one since it's not a renew?

Someone told me that we have to apply a 'replacement' first then renew it. Apparently I prefer not to take this 'two step' way unless we have to. BTW, if we apply a replacement, what the expiration date will be on it? The lost one expires by this June.

Any information will be appreciated.

Thanks a lot...

Sorry to ask such an obvious question, but I wonder if her employer made a copy of the card for their records (assuming she is currently working)?

Even if you apply for a new one, you will still require a copy of the old one because the application asks if you have ever applied before and if so, attach a photocopy (or rather, "documentation"). If you happen to be one of those people who obtained a separate approval notice along with the EAD, maybe that would suffice as documentation. These are just thoughts, sorry if I confused you more.

anyhow your EAD is getting expired by June (about two months from now) now is the time for you to apply for extension right. In your letter you explain the service center about you lost your card bla bla... Probably the service center might waive sending the replacement and you might get the renewed card. attach the approval notice you got from the service center and that way they know that you have been approved.

Good luck

We do have the approval notice which is form I-797 but not sure if it will be enough. We also called a few local attoneys and some say it is not a problem and some say that we have to have the photocopy of the lost EAD otherwise apply a 'replacement' first then do a renew for it (sounds rediculous...). BTW my wife is not working currently so there is no such 'employer' who is keeping one copy...

We really want to hear from somebody who has the same experience on how s/he solve this issue.

Any helpful info will be appreciated.

Thanks for the replies...
