Loosing Green Card and applying for H-1

Hi,

Me and my husband got GC in 2000. He is getting laid off and we are planning to go back in april 04. Before we go, we are planning to apply for re-entry permit. If the economic situtaions improves here and if he gets a job here, we will try to come back within that re-entry valid period.

If not, lets say 5 or 6 years later, if we apply for H-1, will we be counted against the cap.

Are there any other options?
