Limit on number of AC21's?

Hi all,

Is there a limit on the number of times we can invoke AC21? I have already changed jobs once (did not send an AC21 letter). Now I'm planning to take up another job with same responsibilities. I'm not aware of a rule which says that AC21 can be invoked only so many times before we get a GC approval. Am I jeopardizing my GC approval with this?

I believe there are people who had switched jobs using AC-21 more than once as I remember having seen some of the cases in this forum. However, not sure what the CIS's behavior on it as it's been a few months since I had seen them and CIS's attitude towards the cases changes every day....perhaps, every hour :)

------------ no rule that says AC21 request can only be sent one time . you can sent request more than one time. your I-485 will be approved based on job offer of latest letter of the employer you send.

There is never a word like "INVOKE AC21" in any related law. If you meet the condition (approved I140 + 180 days I485 pending ) the AC21 law WILL protect you. No matter how many jobs you switch or stay laid of for a while.

The ONLY thing which matters here is the last/latest/current job letter explaining your job duties and paystubs ... specifically at the time when USCIS is ready to adjudicate your I485. No letter reaches your file thus no LUD will appear.

You are NOT jeopardising your case by any means. Good Luck
 
Thanks for the responses. Since I'll be serving the same role in my new job(s) I believe I'm alright keeping with repsect to AC21 law.

Very right, AC21 is not someting you can trigger or invoke. You just meet the reqs. Also, AC21 is LAW, related memos are just instructions that tell how to meet that law. If USCIS thinks that their memos are not meeting the requirements of the law properly, they can change them anytime they want.

Only thing to be remembered is that a GC is for Permanent Job. Jumping too many times might give an impression that your job nature is temporary or short term. Dont know the implications of such job changing but it is not good theoritically.
