legally present? (Driving license)

I would like to renew my drivers license.

I am in my 4th year of a H1b.

My visa expired in Feb '06; however, I have labor certification (approval) that has the date Feb '09.

My issue is, how do I prove to the DMV that I am 'legally present'? I have spent hours searching the Internet for the answer to this.

Any help is much appreciated.
 
DMV in each state has different rule. If you have H1B approval notice, you will get license renewed upto the expiration date on the H1B approval notice. If your H1B application is still pending with USCIS, you might not get your license renewed with just labor certification. Try your luck with DMV.
 
thanks for the response. I must admit I do get get very confused with the rules and regulations. :confused:

On the the form I received it states work is allowable with my current employer until Feb '09. Not having a stamp in my passport that reflects this, I believe, may pose a problem.

I know that I am legally present, it's the people at the DMV and their knowledge of 'status' that bothers me.

If I remember I submitted I-94 when I applied for license.
It was about 10 years ago, but I think it is the same now. After all, I-94 is only thing to prove your legal status.
