Lawsuit regarding GC delays - CNN

I saw a scrolling news about the lawsuit last night about 11:45pm, but unable to find the full story from CNN.com

does anybody know about this ?
 
Think that lawsuit was regarding the intent of family members of recent tragedy in Texas, where several illegal immigrants died of asphyxation. I would doubt the chances of any lawsuit pertaining to the slowness in emplyment-based AOS procssing....especially in this geo-political and economic climate.

Congratulations on filing the lawsuit against BCIS!

As a green card waiter in California I applaud your move as do many hundreds who have read about what you are doing on the I485 discussion boards at www.immigrationportal.com. I know the Texas Service Center has been notorious in it's approval progress in the past but now it appears that the majority of the service centers are quickly approaching the same slowness. As you are aware, no doubt, that they are using the guise of added security checks after 911, which gives them an almost unassailable position as who would argue with the need for extra security. The truth of the matter seems to be a lack of funding, resourcing and lack of priority to approve the green cards.

I hope things proceed well with either the law suit or it will bring enough pressure onto the department that they will actually act and start approving the green cards at speed. What I, as well as others would like to know, is that while your initial lawsuit was only for certain districts in Texas, it is a class action suit, is there anyway this can be opened up for the rest of the country? We would like to pursue a similar course of action. To date we have sent an petition to the CSC but really are in a powerless situation and suffer the same fate as your constituents in Texas.

The diffrence in these cases is that there is a court order by an immigration judge. After the publicity of the lawsuit, BCIS will probably not risk violating a court order or invite action for contempt of court through further delay. So resources will probably be assigned on a priority basis.

I don't want to guess where the resources will be reassigned from.

I would add that it seems they trying to suck out as much money as possible from pokets of legal immigrants. Just look at this:
1. Approvals of I140 are very fast which make more and more I485 waiters.
2. Every waiter is likely to pay $120 + $130 = $250 for AP and EAD renewals.
3. 1,118,087 pending cases * $250 = $279,521,750 a year for doing nothing!!!! And do not forget to add $305 + $120 + $130 = $555 we paid when applied for I485. That would make over $600M one time payment for everyone of us.

As you can see the revenues of the enterprise are similar to a big public company.

And they are saying about the lack of money? I would like to know where my money went.

BCIS got $3 million this year,
BICE got $996 million.

BICE is mostly spending and BCIS is making a LOT of money. They have about 540,000 initial receipts coming every month (see http://www.immigration.gov/graphics/shared/aboutus/statistics/msrmar03/BENEFIT.HTM) if every form comes with a fee $200 at average it eylds $108,000,000 every month roughly $100M a month!!!!!!! or $1.2B for a year. I guess BICE gets their $996M from our $1.2B and rest is used by BCIS to keep us paying in endless wait.

Thank you for contacting our office. At this time, the lawsuit is
limited to persons who adjusted their status in the Immigration Courts in Houston, Harlingen and San Antonio, Texas. As is everyone, I am aware of the long delays for processing I-485s at the service centers.
Although the media described the lawsuit about delays, it is more about providing temporary proof of LPR status once a person is accorded such status. It is our position that once a person is accorded LPR status, DHS is obligated by law to issue some form of documentary proof evidencing such status regardless of how long they might take to issue the permanent alien card. I have received calls and emails from folks across the country about broadening the scope of the lawsuit. That is definitely an interesting idea to pursue but it would still be limited
to people who adjusted in removal proceedings. So, I'm not sure this would help you or the thousands of others who are still waiting for the Service Centers to process the 485s. Thanks again.

gettingclosernow, atleast it is in their system now. Lawyers are always looking for such publicity, that's what makes them really sought after lawyers. Who knows, someone might pick our plight next.
